A variance for home occupation; code states truclcs shall not be parked overnight in <br />driveways, section 1135.02(b)(6). <br />Mr. and Mrs. Carson, Councilman Orlowski and Ms. Chester were sworn in. Mrs. Carson <br />passed out additional documents to members. She said the truck has been in the driveway for <br />over six years. Mr. Carson reviewed what he does for a living and how his work requires him to <br />be on call. Mrs. Carson said a new driveway was installed in 2007 to accommodate the truck <br />and an addition was added to the back of the house each of which had multiple inspections and <br />nothing was said about the truck. They can not afford to store the truclc and if forced to store off <br />site her husband will lose his business. Mr. Orlowslci said although he is not in favor of <br />commercial truclcs in residential drives, storing the vehicle off site would impede Mr. Carson's <br />ability to complete his work. An email from Councilwoman Jones was read into the record <br />stating her support for the variance. Ms. Chester said she has never seen the truck and supported <br />her neighbor's request. Mrs. Carson said a petition was submitted by the homeowner signed by <br />their neighbors indicating they supported the request. Mrs. Diver was syrnpathetic to the <br />applicant's situation but would be more comfortable if the driveway was fenced and the truclc <br />was not visible from the street. Mr. Carson said he would back the truck into the drive so only <br />the front of the truck was visible. <br />Mr. Lopez moved, seconded by Ms. Rudolph, to ga-ant Daniel & Karen Carson of 5639 <br />Porter Road the following variances: <br />1. Proposal consists of expanding attached garage; the following special <br />permit and variances are requested: <br />1. A special permit to add to a non-conforming building 1165.02(b). <br />2. A variance for total side yard setback; code requires total of 15', applicant shows less; <br />section 1135.07(a). <br />3. A 7 foot variance for a residence too close to the right of way, code requires 50', applicant <br />shows 43', section 1135.06(a). <br />4. A 6 inch variance for an addition too close to side yard property line, code requires 5', <br />applicant shows 4'6", section 1135.07(a). <br />Note: Existing dwelling has a nonconforming side yard setbaclc of 4.5 feet and code requires 5 <br />feet. Existing dwelling has a total side yard setback of 11 feet and code requires 15 feet. <br />Mr. and Mrs. Voiculescu were sworn in. Mr. Voiculescu submitted a letter signed by their <br />neighbors supporting their request. They would lilce to have a two car garage as the existing is a <br />single car. They would like to park their cars in the garage and have room for yard equipment. <br />Mr. Mitchell said he did not object to the request if the 6 inch variance was withdrawn as it was <br />2
