The majority of <br />board members had no objections. <br />Mrs. Diver moved, seconded by Mr. I,opez, to grant Danut Voiculescu of 5981 Fitch Road <br />the following variancese <br />1. A special permit to acld to a non-conforming building 1165.02(b). <br />2. A variance for total side yarcl setback; code requires total of 15', applicant shows less; <br />section 1135.07(a). <br />3. A 7 foot variance for a residence too close to the right of way, code requires 50', <br />applicant shows 439g section 1135.06(a). <br />Roll cal?: Diver, Bellido, Lopez, Rudolph - yes; Sergi - no; rnotion approved 4-1. <br />Gail Pirtle; 5096 Whitethorn Avenue: <br />Request for variance. Proposal consists of an addition; the following variance is requested: <br />1. A 12 foot variance for required front yard setbaclc; code requires 50 feet, applicant shows 38 <br />feet; section 1135.06(a). <br />Gail Pirtle, Kevin Merda, John Folic and Jaclc Esgar and Councilman Orlowslci were sworn in. <br />Ms. Pirtle said she would like to have a two car garage which is twelve feet into the front <br />setback. Mr. Merda, the contractor, said the existing garage will not accommodate two cars and <br />they are redesigning the first floor to accommodate future needs of the owner. The existing <br />garage will be incorporated into the main house and the new garage doors will face sideways to <br />minimize possible adverse affect on neighbors. Mr. Folic said he would not want to see the <br />garage pushed forward as it would impede the neighbors view and change the character of the <br />neighborhood. He is against the variance as codes are set to protect neighborhoods so granting <br />variances encourages others to change their setbacks. Mr. Merda said the garage only extends <br />seven feet past the existing home. Mr. Esgar said the owners have done a good job worlcing on <br />the home and yard but is against the variance as it changes the character of the neighborhood. <br />Mr. Mitchell said the request is 25% into the 50 foot setbaclc which is significant for the <br />neighborhood. Board members had mixed comments but agreed the request would alter the <br />neighborhood and that there were other alternatives. Board members went through the variance <br />standards and found that the neighborhood would be altered, the request was substantial, and <br />there are other alternatives then what is being requested. The spirit and intent would not be <br />upheld granting a 12 foot variance. <br />Ms. Rudolph moved, seconded by 1VIrs. Bellido, to grant Gail Pirtle of 5096 Whitethorn <br />Avenue a 12 foot variance for a-equired front yard setback; code requires 50 feet, applicant <br />shows 38 feet; section 1135.06(a), which failed 0-5. <br />Henrv Justice; 4372 Bentlev Drive: <br />Request for variance. Proposal consists of a new storage shed; the following variance is <br />requested: <br />1. A 30 square foot variance for storage shed larger than allowed; code permits 80 sq ft, <br />applicant shows 110 sq ft, section 1135.02(d)(1). <br />3
