Mr. Justice and Councilman Orlowski were sworn in. Mr. Justice said he would lilce to install a <br />shed which is 10' x 11' x 6'8" and code only allows 8' x 10'. He presented photos of his <br />baclcyard and explained the correlation of the photos to where the shed would be placed. He said <br />he discussed the shed with each of his neighbors who had no objections. Their family is <br />extended as both sons live at home and each has their own vehicle. They would lilce to store <br />items in the shed and malce room in the garage to allow two vehicles to be parlced inside. He <br />purchased the shed and although he knew the required size of the shed felt his needs warranted <br />requesting a variance. Mr. Orlowski said he had no obj ections to the request. Mr. Mitchell said <br />he welcomed the owner trying to clean the property up and remove the non worlcing vehicles. <br />The shed will allow items to be stored and will visually enhance the appearance of the lot. <br />Board members had no objections to the request. <br />Ms. Rudolph moved, seconded by Mr. Lopez, to grant Henry Justice of 4372 Bentley Drive <br />a 30 square foot variance for storage shed larger than allowed; code permits 80 sq ft, <br />applicant shows 110 sq ft, section 1135.02(d)(1), which was approved 5-0. <br />NON RESIDENTIAL API'EALS AND REQUESTS <br />C1VIS10-26: Wa1-Mart: 24801 Brookpark Road: <br />Request for variance. Proposal consists of an addition; the following variances are requested: <br />1. A special permit to add to a non-conforming building; Section 1123.11. <br />2. A variance from Section 1165.02 as existing building is a nonconforming and addition <br />does not comply with all setbaclc, yard coverage and height requirements; Section <br />1165.02(b). <br />3. A 1.87 foot variance for building setback (east); code requires 100 feet, applicant shows <br />58.13 feet, Section 1149.04(c). Note: BZA previously granted 40-foot variance to allow <br />building at 60 feet from east property line. <br />4. A 54.73 to 57.33 foot variance for building setbaclc (south); code requires 100 feet, applicant <br />shows 45.23 to 42.67 feet, Section 1149.04(c). <br />5. A 20 foot variance for retaining wall and access drive in required landscape setback; code <br />requires 50 feet where abutting residence district, applicant shows 30 feet, Section <br />1149.04(d). <br />6. A 9.76 foot variance for retaining wall and parlcing in landscape setbaclc (north main lot); <br />code requires 25 feet, applicant shows 15.24 feet, Section 1149.04(c). <br />7. A 5.18 foot variance for parlcing in landscape setbaclc (south main lot); code requires 25 feet, <br />applicant shows 19.82 feet, Section 1149.04(c). <br />8. A 5.51 foot variance for parlcing in landscape setbaclc (north area of employee parlcing); code <br />requires 25 feet, applicant shows 19.49 feet, Section 1149.04(c). <br />9. 16.37 foot variance for road, sidewallc, curbs in landscape buffering (south west bldg & <br />property line); code requires 25' applicant shows 8.43', Section 1149.04(c). <br />Aaron Matson and Councilinan Orlowski were sworn in. Mr. Matson reviewed the proposed <br />32,000 square foot expansion which included eliminating the garden center and adding <br />additional grocery space. Since the building was first constructed the land had been split into <br />two parcels which created the non-conforming conditions of the site. There will be additional <br />landscaping added, 21 parking spaces are being eliminated and the storm water control system <br />4
