BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MEETING MINUTES OF JULY 1, 2010 <br />ROLL CALL <br />Ms. Sergi called the meeting to order at 7:30 p.m. in Council Chambers. <br />Present: Nancy Sergi, Maureen Diver, Jennifer Rudolph, Laura Bellido, Alfredo Lopez <br />Staff: Law Director Michael Gareau Jr., Building Commissioner Dale Mitchell, Clerk of <br />Commissions Donna Rote <br />REVIEW ESND CORRECTION OF MINUTES <br />Ms.l2udolph moved, seconded by 1Vdr. Lopez, to approve the June 3, 2010 minutes which <br />was approved 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />Robert Hadzima; 6193 Paisley Drive: <br />Request for variance; proposal consists of a shed. The following variance is requested: a 2' rear <br />yard setback variance for a shed too close to the rear property line; code requires 5', applicant <br />shows 3', section 1135.02(d)(5). Note: Existing plastic shed does not require a permit. <br />Mr. Hadzima and Patricia Harboldt, a neighbor, were sworn in. Mr. Hadzima said the shed was <br />constructed six years ago and he was informed that plastic sheds did not require a permit; <br />however a building inspector noted that the shed placement does not comply with code. The <br />shed was placed following the neighbor's request to malce sure it was to the side of his garage <br />along the side of his home which has no windows. The shed was not an issue until the neighbor <br />was violated for the placement of his trailer which had to be moved. Mr. Hadzima's back yard is <br />not very big and moving the shed inward 2%z feet malces a significant difference. He will <br />continue to maintain the area behind the shed including the fence. Addressing his neighbor's <br />letter, the reason his fence is not entirely stained is due to the neighbor stacking wood against his <br />side of the fence prohibiting him from finising the required work. Since the wood was removed <br />the entire fence will be stained. He noted that prior to installing the pool a permit and all <br />inspections were completed. Ms. Harboldt said that Mr. Hadzima's yard is very well maintained <br />and the many improvement projects increases the value of his home and the neighborhood. <br />Mr. Mitchell said he met with the owner in fa112009 and due to weather conditions advised him <br />that the following summer the matter would have to be addressed. He noted that there had been <br />ongoing disputes between the neighbors for years. Plastic sheds are not required to have permits <br />however the placement must meet code. The shed size is not an issue and he has no objections to <br />the request as the area between the fence and shed is maintained. Ms. Rudolph asked if the shed <br />being within the utility easement area was an issue and Mr. Mitchell said no. Mr. Gareau <br />suggested it would be wise for the applicant to give notice to his neighbor that he would be <br />staining his fence to avoid any possible issues.
