BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MEETING MINUTES OF MAY 6, 2010 <br />ROLL CALL <br />Ms. Sergi called the meeting to order at 7:30 p.m. in Council Chambers. <br />Present: Nancy Sergi, Maureen Diver, Jennifer Rudolph, Laura Bellido, Alfredo Lopez <br />Staff: Law Director Michael Gareau Jr., Building Commissioner Dale Mitchell, Clerk of <br />Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Ms. Rudolph moved, seconded by Mrs. Diver, to approve the April l, 2010 minutes which <br />was approved 5-0. <br />NON-RESIDENTIAL APPEALS AND REQUESTS <br />Surf Shop LLC; 27328 Lorain Road: <br />An appeal of Building Commissioner's inspection report of April 15, 2010, listing violations of <br />North Olmsted Codified Ordinance sections 1119.01(a), 1119.01(b), 1119.02(a) and 1119.05. <br />Mr. Gareau said the applicant's Apri127, 2010 correspondence requesting to be tabled until the <br />June 3, 2010 meeting was 'received prior to the meeting and approved. However, the board <br />needs a formal motion to table and reschedule on the June 3, 2010 docket. <br />Mrs. Sergi moved, seconded by Ms. Rudolph, to grant Surf Shop LLC of 27328 Lorain <br />Road their request of Apri127, 2010 to be tabled and rescheduled to the June 3, 2010, <br />agenda which was approved 5-0. <br />RESIDENTIAL APPEALS AND REQUEST5 <br />Robert & Janet Reik; 28565 Windsor Drive: <br />Request for variance (1123.12); proposal consists of a new fence. The following variance is <br />requested: An 18 inch variance for a fence higher than allowed within a 25 foot setback on a <br />corner lot; code permits 30 inches, applicant show 48 inches, section 1135.02( fl(1). <br />Mr. and Mrs. Reik were sworn in. Mrs. Reik said they would like a variance for a 4 foot high <br />picket fence which will extend 15 feet beyond their home. They abut Spruce Elementary <br />School's entry drive and they have a lot of pedestrian traffic through their lawn. The fence will <br />not impede visibility as it will be 50% open and the height is needed for their family dog and <br />grandchildren. Mrs. Reik submitted photos of where the fence would be installed. <br />Mr. Mitchell said he would like to see the picket fence a minimum of 5 feet from the sidewalk. <br />Although he does not object to the height of the fence he would like to see a new site plan <br />submitted accurately showing the location of the fence prior to a building permit being issued.
