Mr. Reik said the fence would be replacing the wooden fence which was removed and be placed <br />6 to 8 feet inward from the sidewalk. <br />Mrs. Diver said she did not object and understood why a fence was being requested. Mr. Lopez <br />felt if the fence was 5 feet from the sidewalk the request was reasonable. Ms. Rudolph believed <br />that the intent of the code would be upheld by granting the variance and asked if the motion <br />should be conditioned upon a new site plan being submitted showing a minimum of 5 feet from <br />the sidewalk. Mr. Gareau confirmed that the motion should contain those requirements. <br />Ms. Rudolph moved, seconded by Mrs. Bellido, to grant Robert & Janet Reik of 28565 <br />Windsor Drive an 18 inch variance for a fence higher than allowed within a 25 foot setback <br />on a corner lot; code permits 30 inches, applicant show 48 inches, section 1135.02(f)(1), <br />conditioned upon a new site plan being submitted showing the fence maintaining a <br />minimum distance of 5 feet from the sidewalk at the southern point of the property, which <br />was approved 5-0. <br />5teven & Loraine Hribar; 6017 Stearns Road: <br />Request for variance (1123.12); proposal consists of a new detached garage. The following <br />variance is requested: A 120 square foot variance for total square footage of garages in <br />combination; code permits 750 sq ft, applicant show 870 sq ft, section 1135.02(c)(3). <br />Note: existing attached garage is 280 sq ft, proposed new detached garage is 590 sq ft, proposed <br />tota1870 sq ft. <br />Mrs. Hribar and Mr. D'Amico, the contractor, were sworn in. Mr. D'Amico said the <br />homeowners have an attached single car garage which can not house their three cars and <br />recreational vehicles. The home is located on Stearns Road which has become a four lane road <br />making it impossible to back out of the drive or maneuver their vehicles. The proposed garage <br />will be located behind the home and will be 20 feet wide by 34 feet deep to fit the narrow but <br />deep lot. The garage includes a 6 foot covered patio and enough area to maneuver vehicles so <br />they can safely exit onto Stearns Road. All downspouts will connect to the new storm water <br />system which was recently installed at the street line to ensure water runoff is contained. <br />Mr. Mitchell said he did not object to the second garage and the manner in which it is being <br />designed will fit into the neighborhood and aesthetically fit the layout of the property. He agreed <br />that onsite maneuverability was needed to exit the site safely. <br />Mrs. Bellido felt the lot could accommodate the garage and the design would fit the lot's layout. <br />Ms. Rudolph agreed that the street traffic was such that the request was warranted as it would not <br />adversely affect the neighborhood. Mr. Lopez said once he visited the location he understood <br />the need to house their vehicles and ensure a method was provided to allow vehicles to turn <br />around to leave the site. Mrs. Diver said after viewing the site and trying to back out of the drive <br />onto the street she understood the need for the variance. Governmental services will not be <br />affected and the spirit and intent of the code would be followed granting the variance. There is <br />no other method than seeking a variance for the garage and turn around. Mrs. Sergi said the <br />board appreciated the applicant's efforts to minimize the size of the garage by adding the <br />covered patio and the neighborhood will not be affected by the request. <br />2
