conditions," in order to time limit certain variances granted pursuant to section 1123.12 and further <br />authorizing the director of Planning and Development to administratively extend established <br />variance time liinitations. <br />Ms. Wenger said the ordinance would amend the Zoning Code to time limit certain variances <br />granted by the Board of Zoning Appeals and allow for the extension of variance time limits of up <br />to one year by the Director of Planning and Development. There have been a few developments <br />which have received approval and in circumstances beyond their control they exceed the one <br />year and this would allow the Director to extend the time an additional year. She reviewed <br />situations which may involve extending the variances approved. Mr. Laslco said he is concerned <br />that if an applicant can't move after a year they should have to return to the commission for a <br />fresh loolc. Ms. Wenger said the variance time frame extension does not allow any changes to <br />take place to the approved plan. Mr. Laslco said he would prefer the ordinances be changed to <br />allow an 18 month period before variances expire. Mr. Parry said a one year timeframe is not <br />enough time for a developinent to properly be conducted. He thinlcs that it could place staff in an <br />awkward position of being accused of allowing one applicant a time extension and not another. <br />Mr. Bohlmann also felt staff should not be placed in such a position. Commissioners felt that <br />variance expiration timefraine should be extended as one year was not sufficient. Most <br />commissioners felt that no one person should be put in a position of such a review. Mr. <br />O'Malley said that the ordinance is clear that there can Ue no changes to the development plan to <br />request an extension. Mr. Laslco was concerned that if zoning laws or other ordinances changed <br />that could affect a previously approved plan or how it would be addressed. Mr. Parry felt an 18 <br />inonth period was reasonable for variance approval but felt it would place a burden on staff to <br />inalce the decision to grant an extension or not which could be a liability. <br />O1tDINANCE NO. 2010-128 <br />An ordinance amending section 1126.10 of the North Olmsted zoning code entitled "expiration of <br />approval," to authorize the director of Planning and Development to administratively extend <br />established time limitations. <br />1VIr. Lasko moved, seconded by Mrs. Meredith to table Ordinance no. 2010-126 and 2010- <br />128 which was approved 5-1; 1VIr. Cotner voted no. <br />1VIr.
