<br />COMMUNICATI0N <br />Ordinance No. 2010-112 <br />An Ordinance amending Section 1139.01 of the Zoning Code of the City of North Olmsted to <br />permit entertainment device arcades in general retail zoning district, subject to conditional use <br />permit and additional area restrictions. Tabled 8/25/10 & 9/8/10. <br />Ms. Wenger said the ordinance amends the Zoning Code to allow for and regulate entertainment <br />device arcades. The companion legislation is Ord. 2010-111, which creates new business <br />regulations for such facilities. The Zoning Code amendment would malce such facilities a <br />conditional use in the General Retail Business District subject to requirements for spacing and <br />separation, miniinum floor area, maxiinum number of machines, and parlcing. The use would <br />also be subject to the criteria listed in Chapter 1118. The Law Director has proposed <br />amendments to one of the definitions proposed for the new section, which has been provided to <br />the Commission for review. The areas will be mapped to ensure there is sufficient area for the <br />uses. Mr. Mitchell said the building department was worlcing with the engineering department to <br />identify all the churches within the city. Mr. O'Malley reviewed the manner in which the <br />cominission should review the ordinance and recommended tabling until the map is provided. <br />Mr. Lasko said there were a number of such establishments popping up in the surrounding area <br />and he Uelieves such legislation is warranted. Mr. Parry asked if restaurants or bars which have <br />video games within their establishments be limited to four and how would restaurants or bars <br />closer then a thousand feet from each other be addressed. Mr. Mitchell said that since the <br />moratorium went into affect they have received six applications and multiple inquires as to when <br />the inoratoriuin would be lifted. Mrs. Meredith questioned what would or wouldn't be <br />grandfathered and Mr. O'Malley briefly reviewed the proposed legislation. Mrs. Meredith <br />questioned if alcohol is served at such establishments and Mr. O'Malley said that would be <br />regulated by the State liquor review Uoard. <br />Mr. Laslco moved, secoiided by Mrs. Meredith, to table until further information <br />pertaining to Ordinance liTo. 2010-112 is received which was approved 7-0. <br />ADJOURNMENT <br />With no further business, the meeting was adjourned at 9:30 p.m. <br />Jffn J.
