Mr. Mitchell said a variance was previously granted for constructing a shed on the vacant lot <br />contingent upon the lots being consolidated within two years which the previous owner never <br />did. The shed was removed and the new owner is following through on consolidating the lots. <br />Mr. O'Malley said that any past errors, would be resolved with the approval of the current plat. <br />Mr. Nicolo reviewed the history of the lots in question. They are consolidating the lots in order <br />to proceed with constructing a garage for the house on the same parcel. Mr. Parry aslced if the <br />rear area of parce1237-12-012 was previously consolidated or was the consolidation talcing place <br />now. Ms. Wenger said that area was the issue being addressed internally as ownership records <br />did not correspond to parcel boundaries on record with the City. <br />Mr. Lasko moved, seconded by 1VIr. Bohlmann, to approve the lot consolidation for <br />CMS10-22 Rocco Nicolo Jr of 4069 Clague Road consisting of consolidating PPN 237-12- <br />O11 (.2296 acre) and PPN 237-12-012 (.3948 acre) into one (.6244 acre) parcel which was <br />approved 5-0. <br />CO1VIMiJNICA'I'ION <br />God and tlze Mall, APA article <br />Ms. Wenger said the article was submitted for interesting reading after what the commission <br />addressed earlier in the year. In reading the article she found it interesting that some of the <br />drawbaclcs and positive topics were mentioned just as they were when the commission was <br />addressing the topic of churches locating in malls. Mr. Laslco said he has been watching law <br />regarding internet cafes which is now showing up in the court systems. Ms. Wenger said in <br />August there will be legislation introduced which will regulate internet cafes. <br />Mr. Lasko moved, seconded by 1VIr.
