the light could be replaced with a shielded light which meets code and a new photometric plan <br />submitted reflecting the readings and Mr. Mitchell said yes. Mr. Laslco said the commission will <br />require the northeast wall light and photometric plan meet code and no variances sought which <br />Mr. D'Amato agreed to. <br />Mr. Bohlmann aslced why the fence does not adjoin the neighboring fence and Mr. Fabo said the <br />existing fence does not meet the property line and the gap ensures the area behind the fences can <br />be accessed and maintained. Mr. Bohlmann said the 20 foot area behind the fence being <br />installed would be the responsibility of the owner to maintain. Mr. Parry said given the number <br />of trees being removed, he didn't feel the pear trees proposed would provide adequate screening <br />for the abutting neighbor. He suggested that pine trees be planted as well. Mr. Fabo said that <br />pear trees are fast growing and have a higher dense canopy which will provide faster screening <br />above the fence line. Mr. Parry aslced why the fence was not being continued along west side of <br />the new parlcing area. Mr. Fabo said that the northwest area of the lot has dense screening and <br />there will be no landscaping removed. Mr. Bohlmann said in walking the site he noted that the <br />west side of the lot had sufficient landscaping to buffer the residents however the Willet Circle <br />hoine may require additional buffering. Mr. D'Amato said he would worlc with Mr. Malone and <br />the homeowner to see what can be done to ensure adequate buffering is provided. <br />Mr. Mortach, the abutting neighbor, asked if all the evergreen trees would Ue removed and Mr. <br />Fabo said twenty existing trees will be removed. Mr. Mortach said it will be a big change when <br />the forty foot trees are removed and replaced with just a fence. He aslced if additional trees could <br />be installed to soften the fence and add buffering from light glare. Regarding the northeast wall <br />light, it shines into his home now even with existing trees so once the trees are removed the glare <br />will become stronger. Mr. Lasko said the applicant will work with Mr. Malone to ensure that the <br />buffering is such that Mr. Mortach will not have adverse lighting on his property. Mr. Mortach <br />said Mr. D'Amato had always been a good neighbor and promptly talces care of issues that arise. <br />Mr. Lasko moved, seconded lby Mr. Rerko, to approve the proposal for CMS10-18 Nissan <br />of North Olmsted of 28500 Lorain 12oad with the following conditions: <br />1. Fencing details shall be listed on worlcing drawings noting the rnaaterial, type and style <br />of fencing. The fence will be 10 feet high at the lowest point. <br />2. A new photometric plan will be submitted which will include a wall mount light fixture <br />in tlie northeast corner that is code compliant. <br />3. The applicant will worlc with 1VIr. 1VIalone to address additional landscaping along the <br />northeiā¢n property line to adequately buffer the residential neighbor. <br />The motion was appi-oved 5-0. <br />CMS10-22 Rocco Nicolo Jr; 4069 Clague Road: <br />Proposal consists of consolidating residential permanent parcels 237-12-011 (.2296 acre) and <br />237-12-012 (.3948 Acre) into one (.6244 acre) parcel. <br />Ms. Wenger said the proposal is to consolidate two parcels resulting in one parcel which will <br />meet all zoning requirements for lot area, width and depth. She noted inconsistent records <br />pertaining to past splits and consolidations involving the property. However the plat before the <br />Commission conforms to zoning code requirements and the approval will clear up those issues. <br />2
