As <br />with other patio proposals, there are always concerns regarding the impact of noise on <br />surrounding residential properties. Therefore she recommended the conditions of no outdoor <br />speakers, propping doors open or any additional type of lighting added to the patio or building <br />other than the three bollard lights shown. In visiting the site property maintenance issues were <br />found such as a pile of wood timbers being used to prohibit the west drive from being used, old <br />tires abandoned in the rear green space and beer bottles throughout the site. The dumpster <br />enclosure is brolcen and multiple dumpsters were scattered throughout the back of the plaza. The <br />current condition of the site does not represent itself well. <br />Mr. Mitchell said he requested the police research the past two years of noise complaints and <br />since 2008 there've been two complaints one of which was an abutting neighbor not the plaza. <br />Property maintenance complaints were also researched and it was found that in January 2008 the <br />bar owner erected a tent along the west side of the building which did not meet fire code ratings, <br />included decorative lights, electrical extension cords and portable propane heaters which was all <br />removed once the property owner was cited. The two variances required are for the patio <br />fencing and business being conducted within the 75 foot front setbaclc. Decreasing the width of <br />the west drive creates safety concerns for the patio and possible issues with the safety forces <br />being able to maneuver the site. The owner should loolc to moving the patio east an additional <br />parking space to maintain the west drive width. Bollards should be loolced at being placed in <br />front of the patio fence to protect the fence from being hit by vehicles. <br />Mr. O'Malley said there was enough issues raised to table the proposal as neither the property <br />owner or bar owner were present. The safety forces should also be asked to address possible <br />adverse impacts on their ability to maneuver the site. Adverse impacts including noise levels, <br />traffic flow and maintenance issues can only be addressed by the owners. Mrs. Meredith said the <br />commission would address the site plan but the applicant would be tabled until the owners were <br />present to address concerns raised. <br />Mr. McGettriclc said the patio would be moved 5 feet to the east to maintain the 15 foot driveway <br />and bollards would be used in front of the fence to protect it from damage. There will be no <br />outdoor speakers or additional lighting added to the patio area. He asked if the city wanted the <br />west drive access eliminated. <br />Mr. Rerlco said safety forces should address site access prior to blocking the west drive even if <br />the patio is moved 5 feet east. Bollards should be placed at each fence corner and curb stops <br />used along the perimeter of the fence to ensure vehicles cannot back into the patio. The planters <br />being added to the patio should be placed for better maneuverability. The existing concrete <br />wallcway to concrete patio should be doweled to ensure a difference in settlement doesn't occur. <br />The dumpsters along the back should be located in a central location and enclosed. It should be <br />determined if 6 dumpsters are warranted for the site. <br />Mr. Malone aslced the size of the planters and where they would be located on the site. Mr. <br />McGettriclc said the planters are 2 foot square and will have a bench between them to provide <br />additional seating. Their placement will be used to brealc up the concrete appearance.
