BOARD OF ZONING APPEALS
CITY OF 1oTOIZTH OLMSTED
1VIINUTES OF JUNE 2, 2011
ROLL CALL
Ms. Sergi called the meeting to order at 7:30 p.m. in Council Chambers.
Present: Nancy Sergi, Maureen Diver, Laura Bellido, Alfredo Lopez, Jennifer Rudolph
Staff: Law Director Michael Gareau Jr., Building Commissioner Dale Mitchell, Clerk of
Commissions Donna Rote
RESIDENTIAL APPEALS A1VD REQUESTS
Robert Brinkley; 24895Maple Rid2e Road
Request for variance. Proposal consists of an addition to existing garage, the following variance
is requested: a 354 sq. ft. variance for a detached garage larger than code allows; code permits
750 sq. ft., applicant shows 1,104 sq. ft., Section 1135.02(c)(1). Note: Existing detached garage
is 624 sq. ft. Proposed addition is 480 sq. ft. Proposed total square footage = 1,104 sq. ft.
Mr. Brinkley was sworn in and said his intent is to add onto his existing garage as his lot is 100'
wide and over 300' deep. The garage is currently 24' by 26' and the addition will be 25' by 24',
the existing garage is not large enough to store the yard equipment and tools. Mr. Mitchell said
the garage is required to have downspouts and drainage will be addressed with the engineering
department. Therefore he does not object to the request. Ms. Rudolph asked if the existing
sheds and temporary car shelter would be removed. Mr. Brinkley said both sheds and shelter
would be removed once the garage is completed. Mrs. Diver asked if city council had addressed
providing a scale for maximum size garages depending lot sizes. Mr. Gareau said unlike the
scale for sheds garages have not been addressed to date. Members briefly discussed placing a
condition on approval to prohibit any future buildings being added to the rear yard. Mr. Gareau
advised against placing a restriction on an owner which would prohibit the owner from
exercising their rights. The majority of the board felt the board should not restrict an owner from
having something they are within their right to have. Members felt that the yard was large
enough to support both the garage addition and an outside structure.
Ms. Rudolph moved, seconded by Mr. Lopez, to grant Robert Brinkley of 24895 Maple
Ridge Road a 354 sq. ft. variance for a detached garage larger than code allows; code
permits 750 sq. ft., applicant shows 1,104 sq. ft., Section 1135.02(c)(1), which passed 5-0.
REQUEST FOR RECONSIDERATION
North Olmsted Towne Center; 28400 Brookpark Road:
Proposal consists of a request for reconsideration
Mr. Gareau said the request for reconsideration is from an applicant who was denied their
variance requests at the May meeting. He advised members as to how they should address the
