He has
safety issues with all the arbors. For him, splitting them into two issues will not make a
difference. Ms. Bellido does not feel the arbors perpendicular to the house are an issue, just the
front arbor. Ms. Sergi is also concerned with the arbor at the sidewalk. Pedestrians would not be
seen by motorists exiting the driveway and the pedestrians may not be able to see the motorists.
The arbors perpendicular to the house with vines hanging down could also become a safety issue.
Ms. Rudolph moved, seconded by Mr. Lopez, to grant Michael Isabella of 4199 Clague
Road the north/south arbor, adjacent and parallel to the sidewalk, parallel to Clague Road
as a fence higher than 30"; code requires 30 inches, applicant shows 10' -12', Section
1135.35(F)(1). Motion failed 5-0.
Ms. Rudolph moved, seconded by Ms. Bellido, to grant Michael Isabella of 4199 Clague
Road a variance for the arbors in the yard, perpendicular to the house, running east and
west as a fence higher than 30"; code requires 30 inches, applicant shows 10' -12', Section
1135.35(F)(1). Motion passed 3-2.
James Helms; 24136 Mastick Road:
Request for variance. Proposal consists of a shed; the following variances are requested:
1. A 1380 sq. ft. variance for a storage building larger than code allows; code permits 300 sq.
ft., applicant shows 1680 sq. ft., Section 1135.02(d)(1).
2. A 5 ft. 9 in. variance for a storage building higher than code allows; code permits 12 ft.,
applicant shows 17 ft. 9 in., Section 1135.02(d)(1).
Note: Existing structure 30 ft. x 30 ft. (900 s fl to be demolished. Current structure is two
stories, approximately 30 ft. high. Total square footage of the first and second floor is 1730 sf.
James Helms of 24100 Mastick Road and Terry Brennan of 24193 Mastick Road were sworn in.
Mr. Helms currently has a yellow barn on the property that was built in the early 1920's. The
barn is in poor condition and requires repairs which exceed the value of building. It is more
economical to replace the barn and he is therefore requesting variances for height and square
footage. The existing barn is two stories tall and 1720 square feet. A one story 1680 square foot
barn is proposed, which is three feet shorter than the existing. Mr. Helms has spoken to his
surrounding neighbors and they signed a statement indicating support of the variances, which
was submitted to record. He chose the style of the barn based on height for intended use and for
aesthetics. The style blends well with the neighborhood, the other barns in the area, and is
similar than the 1920's style barn it will replace. He intends to park his trailers and tractor in the
new barn along with personal storage. Mr. Brennan lives across the street and has lived in the
neighborhood his entire life. Mr. Helms has done much to improve the neighborhood. The
proposed barn is replacing a defective structure and will not detract from the neighborhood. He
requests the board look favorably upon the request.
Mr. Wenger said neither she nor Building Commissioner Mitchell objected to the request. Mr.
Gareau said the administration has taken a keen eye towards abatement of property maintenance
issues in the city including structures in disrepair. Therefore, the Law Department looks
2
