He assumes they have to comply with all the ordinances, but who <br />makes sure these companies are bonded, licensed to put soinething on the CEI lines. The Planning board stricily reviews the zoning <br />issues here, as far as compliance with building codes, state and local that comes through his <br />office. Mr. Rice questioned if LCC had put an antenna in a CEI tower outside this area before. <br />Ms. I'ox indicated they are starting three different sites now in Middleburg Heights which are <br />now under construction. Mr. Rice indicated as a resident on the west side he doesn't want tlus <br />area to be the first area to have one of these things in a power line for all the bugs to be worlced <br />out. It is hard enough trying to sale a house on that side of town and the CEI towers don't help <br />mattei-s as they are eye sores. Anything more you put up in that area that is not appealing is not <br />going to help the value of the properties tliat are already up foi- sale now. It could be placed <br />past the soccer facility were there is no more homes. Mr. Koeth indicated he lived on that side <br />of town and he would not lilce to see anymore towers, that is wlry they are trying to regulate <br />were they are put. Mr. Spalding suggested if CEI wanted to ptit in a taller tower they could and <br />he doesn't see that the antenna is going to cause any disfigurement to were Mr. Rice lives by <br />having five feet antennas on their tower. Mr. Brennan suggested it is a nice application as far as <br />the installation of these antennas, if you drive down 71 and look at the work that is being done <br />in Middleburg Heights you can barely tell they are present. Mr. Tallon suggested the <br />Commission is trying to face the problem of putting these antemias in the most least <br />conspicuous place. This area is the least intrusive place for the antennas. Mr. Tallon <br />questioned Ms. Fox regarding lights or alarms on the antenna. 1VIs. Fox indicated there would <br />be no lights or alarms. Mr. Tallon indicated we will ask you to put a fence around the cabinets <br />on the ground. Ms. Fox indicated that CEI would not allow a fence around the cabinets. Mr. <br />Tallon suggested LCC should negotiate sometiiing with CEI so they will allow you to put a <br />fence around the cabinets so kids playing in that area wouldn't get hurt. Ms. Fox reiterated that <br />CEI has to have access to the towers so they will not allow a fence, Mr. Conway suggested the <br />Commissioners request a letter from CEI indicating why they would not allow a fence around <br />the cabinets, then Ms. Fox could present the letter to the Boai-d of Zoning appeals. Mr. Asseff <br />strongly suggested that the letter from CEI be explicit as to what type of fence they will or will <br />not allow. Mr. Asseff asked since it is 5' feet higher then the tower does there need to be some <br />kind of red light for air traffic. Ms. Fox suggested FAA reviews these antennas site by site and <br />this is not even near 200' feet and that is the limit for rAA. Ms. Fox suggested if you look <br />south of their site there is an antenna on the tower now. Mr. Tallon suggested if it is in North <br />Olmsted there Uetter not be one there now, and asked Mi-. Conway to make sure it was in the <br />Township and not in North Olinsted. Mr. BI-ennan aslced if tlzey should do tlle inovement <br />pending the ordinance. Mr. Dubelko indicated that he and Mr. Conway had discussed this issue <br />Uefore the meeting and he thinlcs that would be a reasonable approach. The Commissioners <br />could send them for a variance and recommend that the variance be passed conditioned upon <br />compliance of all the terms of the new ordinance, but that is getting to complicated. The best <br />thing to do is what Mr. Conway suggested earlier to conditionally approve it conditioned upon <br />number one this ordinance passing 01' SOlTletlllllg substantially like it passing and complilnce <br />with the provisions of that ordinance. <br />7
