entities to come ui and construct these towers but it preserves to the local governments, like the <br />City of North Olrnsted the power to regulate their location just so long as we don't exclude <br />them from North Olmsted. So we have the authority to in act zoiung legislation which we have <br />pending now, that will try to lirnit the number of them. The City can not band them, but can <br />attempt to limit the number of towers in the City. The City can attempt to encourage location <br />such as this proposals location on an existing tower. The City can limit the number of towers, <br />limit their locations, and try to do the best job it can as a City to make them as inconspicuous as <br />possible, that is as far as we the City can go. They have a license from the federal govermnent <br />to come in and conduct their business. Mr. Paulot asked what are the ordinances that are <br />proposed going to do. Mr. Dubellco indicated that is going to be discussed later in tonight's <br />meeting there are two ordinances, one that establishes a new chapter in the zoning code, wluch <br />advises the condition and location of these types of stiuctures. Mr. Paulot suggested when the <br />power station was built it was the same thing, it had to be right by Lorain Road, it couldn't be <br />north of the road were nothing was. T1iey were able to get their truclcs in and out to put the <br />poles in but wouldn't be able to get to the power station so it was allowed to be put right on the <br />edge of Lorain Road. Mr. Paulot suggested we live there and compaiues keep coming in <br />wanting to do this and that on the west side of the City, everyone lives the other way so there is <br />no concern about what is going on around this area. Mz-. Dubellco suggested he felt there were <br />a lot of residents who lived on the west side. Mr. Paulot indicated well that is how it seams, it <br />has been going on for years now first witli the power station, then the re-zoning had to be <br />changed for tlus and that. Mr. Dubellco indicated there was a proposal to construct a Mona <br />pole in the area of the indoor soccer field. The City Administration discouraged that for the <br />exact concerns the audience members had. So they have chosen to go onto an existing site, and <br />from the Cities view point that is better. It is better for them to attach to an existing tower then <br />to build a new tower on a new section of the west side. Tlus site is consistent with our policies <br />as a City to try to limit the number of these things in the City. Mr. Paulot questioned if there <br />would be any lights or alarms put on the tower. Mr. Tallon indicated "no". Mr. Rice a <br />concerned neighbor, indicated he agreed with Mr. Paulot's concerus, and indicated there is a lot <br />of property for sale irl this area and liaven't sold because of tlie unsightly towers. If you allow <br />this company, can you reject another company. Mr. Tallon indicated there will be more <br />compaiues coming and it is our job as a City to find the least intrusive place to put them. Mr. <br />Rice asked how old the LCC company was. Ms. Fox indicated they are a startup company and <br />we have started building here and in New York for the past year and a half. Mr. Asseff asked if <br />that was public or private. Mr. Rice asked if this company goes belly up are we left with the <br />tower i-emaining. Mr. Tallon indicated the proposed ordinance states they have to remove their <br />anteiliias wheii they leave. Mr. Rice questioned if any research had been done to find out if the <br />antenna prottuding above the CEI lines were to be hit by lighting and fall onto the CEI wires if <br />it would knoclc the power lines out. Mr. Tallon suggested lie could not answer that question <br />but would like to thinlc that CEI would've loolced at that very hard before they allowed an <br />antenna to be ei-ected on their pole. Mt-. Rice suggested this is a business and CEI is leasing this <br />space so they are looking at the amount of money they could make, they don't live in this area. <br />Mr. Tallon indicated PUC would make them pull down all of them if that were the case, so he is <br />sure that CEI has made sure that wouldn't happen, don't misunderstand nothing is impossible, <br />but he is sur-e it was looked into. Mr. Brennan indicated this is not the first antenna to be put on <br />a CEI towei- thei-e is one south in Middlebui-g Heigllts that has been sittitlg ther-e for about six to <br />6
