Mr. Hoelter <br />suggested yes what he is talking about is location and everything else so that if the residents meet <br />with Mr. Papandreas and stuff like that we would like it in one portion and they would say they <br />wish they would've known about that back in November because we could've done something <br />about it but since that time we've made architectural changes and paid for them, it's now null <br />and void. They either have to spend the money to undo what they did or we're locked into a <br />nuisance. Mr. Dubelko stated, if it is an exterior alteration and relates to the location of a <br />structure attachment to the building that is something that does deal with the zoning code and it <br />would be "locked in" if the Planning Commission approved it. On the other hand, if it is at that <br />location, and it is causing a nuisance condition on abutting neighbors, the City can regulate <br />through business regulation. Mr. Hoelter suggested he is either not hearing right or it's just not <br />coming into me or what ever. He is going to ask a question maybe he is out of place maybe not. <br />He doesn't feel that he can discuss this project without all of the information in front of use, and <br />he would like for this meeting to be adjourned until we do have all this information in front of us, <br />he knows he doesn't have the authority to do it but is asking the panel to review what they have <br />in fronfi of them and see if they can do their total job with the information that was brought to <br />them tonight. We are in compliance with all the applicable codes. Mr. Conway suggested <br />they are talking about the location of roof top units and it's been the past history of this board to <br />screen them and things of that nature. Mr. Papandreas asked is there any additional ones and are <br />were are they. Mr. Crook suggested there is a compressor house that will be located kind of in <br />the rear of the store there is an off set between Media play and Sport Mart it comes in a <br />complete box trailer basically. Right now there are two issues there's the screening and the <br />noise. The compressors are in itself enclosed prefabricated, basically its a trailer it comes in a <br />metal exterior which is the same screening it's the buff color that matches the brick, and it will <br />meet the 50 decimals levels at the property line, that is the requirements we have given the <br />manufacture. Mr. Hoelter questioned what is 50 decimal levels. Mr. Conway suggested that is <br />the minimum the City will allow. Mr. Hoelter suggested what he is asking is what is it equal too <br />stufflike that. Mr. Conway suggested it is pretty quite. Mr. Crook suggested lower then a radio <br />playing which is about 80 decimals, less then a lawn mower at a hundred feet. Mr. Conway <br />suggested this Commission has the right or the authority to require additional screening, they can <br />not stop them from putting roof top equipment on but you can stop them from making it visible <br />or for noise transmission. Mr. Tallon suggested for some reason it is not noted on the drawings. <br />Mr. Conway suggested roof top equipment is ever specifically noted. This board addresses it <br />and talks about screening it, and he asks if the parapet walls are screened and that type of issue. <br />Mr. Hoelter suggested the reason why he brings this up and the compressors he is talking about <br />are for the stores food coolers and freezers these will be running 24 hours a day 7 days a week, <br />16
