them they have been removed from their hinges they can't be closed. Mr. Koeth asked if he
could ask Mr. Hoelter if he could ask him a question, has that been expressed to the developer.
Mr. Corey suggested why haven't you called us about this problem, when ever you have called in
the past we have responded. He saw NIr. Herbster at Dairy Queen, he made a complaint and he
saw him Sunday night and Monday morning he had people out there fixing the problem, that's
amazing you stand up there making this kind of accusations. Mr. Hoelter indicated they are not
accusations go look that is all he is asking. Mr. Corey indicated they are, you have never once
called our office and he is the one who negotiated the 80,000 square feet restriction you are
talking about and it was not to exceed two stories and that was always the intent. You have
clearly misrepresented a position and you (Mr. Hoelter), Mr. Herbster and myself and Mr.
Papandreas stood out there in that lobby and talked about it. It was never ever to become an
ordnance, we suggested and moved Wal-Mart if you remember you guys. Mr. Tallon called for
order. Mr. Hoelter suggested he never intended that. Mr. Corey somebody called Mr.
Papandreas a lire earlier and that is just iJN-called for, you know we could've put a movie
theater in there 67,000 square feet which would have met and made everybody happy if their
concerned about 80,00 square feet, but some lady said a grocery store gets 21,000 thousand cars
a weekend, a movie theater brings in 80,00 thousand cars a weekend, we would have met the
spirit and the intent of any and every single law that is on the books, put a movie theater there
and killed the area with traffic. We didn't do that we left our store empty for two years loosing
60,00 thousand dollars a month because we tried to do what we felt was the right thing to do for
the City and the neighborhood, and this is the kind of crap we get. Mr. Corey indicated he
doesn't think it is fare nor is it right. Mr. Tallon again called for order. Mr. Tallon asked Mr.
Hoelter to be a little more brief and continue. Mr. Hoelter suggested he looked at the site on the
way past, and according to all the advertisements in the Media Plays window the site is still
available, and he has the number and stuff like that. There are no building permit applied for
signs there are no building permits in the windows stuff like that, he doesn't know if that has to
be put up ahead of time, but what he is getting at is they are saying that they are willing to talk
and listen to the residents how are we going to know what is going on if they don't communicate
with us, they went before the Architectural Review Board without being on the published
agenda, we were told that we are supposed to check for the meetings and go to them when we
feel that an issue is there that we are interested in, how do we go to those meetings and get
things checked if they are not on the agenda. Mr. Tallon suggested it was explained earlier that
obviously there was a mistake in communications somewhere anyway those issues are mute, and
they will be recommended back to the Architectural Review Board. Mr. Hoelter suggested, but
again it's the spirit like their talking about that their willing to talk to us willing to get
suggestions and stuff like that but he doesn't always see it. As fare as the doors and stuff like
that, personally he doesn't live at that end so it hasn't been a large problem for him that is why
he hasn't called but it was called to his attention, and asked to be brought up to this, that is why
he is doing this, in a certain case he guesses he is like a messenger, shot the messenger type deal.
Mr. Corey apologized and indicated every time he has called us we have responded to it, to
satisfy it, and not one person has called to discuss any aspects of the project. Mr. Hoelter
suggested he didn't know that and he can't. Mr. Corey asked if Mr. Hoelter had called. Mr.
Hoelter indicated no like he said it's not my area and he doesn't see it, but there are some things
he is concerned about if this (This part of the tape has multiple audience members speaking out
loud and can not be transcribed.) Mr. Hoelter suggested the first time he hear about it in reality
18
