Mr. Hoelter suggested after reviewing <br />the site some very alarming questions came to mind which he feels must be answered, and these <br />are strictly questions he doesn't know the legal answers but he thinks by going through minutes <br />and things like that we can find them out. Is this the Sherwin William's the site that the EPA was <br />asked to view for the possibility of toxins. Is the Sherwin William's site that the EPA drilled test <br />wells on for hazardous waste and toxic chemicals. Is this the Sherwin William's site that the <br />EPA decided to keep the test wells in place and in operational for a substantial period of time. <br />He doesn't have the dates of these meetings in which the EPA issues were discussed, but he is <br />sure that they can be substantiated if you review this land site. He guesses his questions are has <br />this been disclosed to the land developers number one cause Mr. Papandreas has been to all of <br />the meetings and has heard about this portion of it, but he doesn't know if the developers know <br />stuff like that because he is only a rep of the development company, and have the tenants that <br />would be leasing this site also been informed of this EPA possible concern. Specially if the <br />tenant is that is considering the site is a food chain is going to have unwrapped food on site. <br />This is a personal point on my thing, if he was in any way involved with reviewing and O.K.'ing a <br />food store on this EPA site he would be very leery of the legal ramifications of giving a <br />developer a clean bill of health. Many people feel that once a governing body gives it's blessings <br />to a project everything is without worry or concern. He guesses who would be held liable if at a <br />later date litigation were to surface, the City it has had prior knowledge of this possible concern, <br />the developer representatives have been given knowledge of the possible concerns, and the food <br />chain has been given knowledge of this possible concern. The only thing he can say is after <br />seeing some of the political comics in the new papers and stuff like that, this could be a real <br />horror story and he can imagine what the political cartoonist would have it would be a real field <br />day, that is a11 he has to say he appreciates the Commissioners time and he is glad he is not sitting <br />were you people are. The clerk asked if she could have a copy of Mr. Hoelters papers. Mr. <br />Hoelter indicated "yes' and asked if he could have a copy of the minutes once they are published <br />because he would definitely like to have a copy to have for future reference. Mr. Tallon asked if <br />Mr. Papandreas if he wanted to respond. Mr. Papandreas answer is inaudible on the tape. <br />R. Tallon moved to send Water Tower Square (Giant Eagle), 27524 Lorain Road, proposal <br />consist of renovating a portion of the exterior front facade of the existing shopping center to <br />accommodate a Giant Eagle super market to the Architectural review board. After the <br />Architectural review board they will return to the Planning commission and at that time Mr. <br />Tallon would like to have the location of the roof top units included on the drawings with the <br />screening provided also the compactor enclosed in the building materials. Mr. Tallon asked if <br />there was anything else. Mr. Spalding indicated he would like to have a representative from <br />Giant Eagle present as he has questions about the store itself, as to the entrances, as to the truck <br />matters the chairman just referred to, and he thinks that it is a fair representation it is necessary, <br />as the Citizens have some questions certainly to him or her who ever might be their <br />representative. Mr. Papandreas stated he would certainly address the boards concerns relating <br />to screenings and all that, but what is before you is the review specifically of the facade, now is <br />there a reason that we are coming back because of the facade. Mr. Tallon indicated you have to <br />go to the Architectural review board on their recommendations to us we will make our approval <br />of the project or disapproval. Mr. Spalding informed the chairman he was addressing the <br />entrances to the store itself not the entrances to the facade. Mr. Tallon suggested that was going <br />19
