• ? -? . <br />. <br />Mr. Tallon reviewed the direction in which Mr. Wardrobe's current home faces and questioned <br />Mr. Zart if a home was going to be built on lot B. Mr. Zart suggested a house would be built on <br />lot B and it would comply to the current zoning codes. Mr. Tallon reviewed the required 50' foot <br />front yard setback., as well as the side yard setbacks not being less then 15' feet total if there is an <br />attached garage and not less then a total of 20' feet total if it is a detached garage. Mr. <br />McDermott Assistant Engineer suggested Mr. Tallons figures were correct as long as the lot is <br />not a corner lot those requirements would apply unless they applied for a variance. Mr. Wardrobe <br />questioned if he had a say over the lot being split. Mr. Tallon indicated that is why this meeting is <br />held so that the surrounding neighbors as well as the general public can voice their opinions. Mr. <br />Zart suggested he would like to show Mr. Wardrobe the plans and review what would be done to <br />both sites. Mr. Zart, and Mr. Wardrobe reviewed the plans together. Mr. Tallon suggested the <br />front of the new house that will be built on parcel B will be 10' feet off the south end of your <br />property. Mr. Wardrobe asked if the trees will remain. Mr. Zart indicated they would be keeping <br />as many trees as they can but could not say for sure what trees would remain as no plans have <br />even been drawn for the proposed house. Mr. Wardrobe asked about water drain runoff once the <br />lots grading changes. Mr. McDermott Assistant City Engineer the applicants have to submit a <br />topographic survey (site plan) showing how they are going to accommodate the water runoff <br />from the lot. They have to have inlets, and connect it to a sewer line. They are not permitted to <br />dump on their neighbors. Mr. Wardrobe indicated even since the City has done the work on the <br />drainage system in this area my basement has flooded once. Mr. Tallon indicated they will not <br />get an occupancy permit until the site is approved by the Engineering department. The <br />engineering department sends out an inspector to make sure the grades are proper so the property <br />drains properly. Mr. Wardrobe suggested it should be put on the record that there is a water <br />problem in that area and it should be taken care of before they build on that site. Mr. Tallon <br />indicated it is a matter of the ordinances that the code be followed. <br />Mr. Tallon moved to approve the proposal to divide Permanent parcel Number 231-21-009 into <br />two parcels to create a second buildable lot. The location is the "L" shaped lot adjoining the - <br />corner lot at the southeast corner of Walter Road and South Oxford Oval. Zoning is C-residence, <br />single entirely, both parcels conform to frontage, depth and area requirements of the zoning Code. <br />However the two existing garages serving the house at 3461 Walter Road must be removed to <br />conform to the setback requirements from the proposed property line between the two new <br />parcels.
