<br />per the traffic engineers request; comply with previous planning commission recommendations as <br />well as recommendations from the architectural review board; there is to be a sidewalk on the <br />north side of the driveway ofF of Clague Road; the lighting on the sign is not to be back lit; and <br />any lighting down the driveway is to be shielded from the residential areas. Mr. Tallon noted the <br />proposal must return to planning commission if the city traffic engineer has a problem with the <br />traffic study. If the traffic engineer is satisfied with the traffic study, the proposal can move on to <br />the B.Z.D. committee of council. The motion was seconded by S. Asseff and unanimously <br />approved. Motion carried. <br />2) All Tune & Lube (Old Ziebart Location) 5242 Porter Rd. <br />Request conditional use permit, Planning corrunission granted a 1 year temporary permit on Feb. <br />25, 1997 to do auto repairs. NOTE: No known complaints are on file with the City at this time. <br />There was no representative present for this proposal. Mr. Tallon opened up discussion for <br />audience participation, but no interest was expressed. <br />Considering there were no complaints, R. Tallon moved to grant All Tune & Lube (Old Ziebart <br />Location) 5242 Porter Rd., a conditional use permit, on a permanent basis to do auto repairs. <br />The motion was seconded by W. Spalding and unanimously approved. This submittal is subject to <br />approval by city council. <br />3) Auto Body Services, Inc., 28415 Lorain Road <br />A proposal to construct a new (8100 square foot) block building. <br />Variance will be required. <br />Mr. Mills, Mr. Kovalchuk's attorney, presented the proposal. The planning commission approved <br />a conditional use permit a year ago. Tonight we will review the development plans. Mr. Mills <br />asked that the agenda be changed to read Variance will be required as they only require one <br />variance. Assistant Building Commissioner Rymarczyk agreed that only one variance would be <br />needed, which is for a 5 foot side yard variance on the east side of the property. Mr. Mills <br />informed the commissioners that the proposal included a new color scheme, which was presented <br />to the commissioners for review. The roof shingles will be frost gray, the center of the building <br />will be light gray, and the bottom trim will be a dark gray. Mr. Tallon asked why the color was <br />changed. Mr. Mills suggested the owners of the building noticed the colors were the same as <br />Burger Kings colors so they requested the color be changed. Mrs. O'Rourke asked if the trim on <br />the building would be white. Mr. Kovalchuk replied yes it will be white. Mr. Tallon asked Mr. <br />Rymarczyk what are the parking requirements for this site. Mr. Rymarczyk suggested Auto Body <br />Services fell within the requirements because the spaces inside the building can be added to the <br />total amount required. The spaces they are required to have is seven (7) car spaces and (1) <br />Handicap space. Mr. Brennan voiced his concerns over smells that will migrate from the building <br />when any painting is being done. Mr. Mills assured board members that the spray bake unit that <br />they will be using is self contained, and EPA governed. This system will emit very little odor. We <br />are also concerned about odors, if you notice on the drawings there are not a lot of unneeded <br />openings. Mr. Brennan asked if the seven (7) parking spaces in the rear of the building would be <br />used to store vehicles. Mr. Mills suggested most of the business Mr. Kovalchuk has now is by <br />appointments only, there are no appointments for car wrecks, but they will only be delivered to <br />7 ?
