Mr. Tallon explaiued the only concem is <br />the uusightliness and he wanted to make sure velucles are always stored in the fenced in area. <br />Mr. Brenuan questioned if Mr. Patton would be towing for other cities. Mr. Patton advised <br />he works with the Westlake and Avon Lake Police Departments. The Westlake velucles are <br />stored in a lot on Mill Road and the Avon Lake Velucles stored in a lot on Lee Road. Mr. <br />Brennan questioned if those velucles would ever be towed to this North Olmsted lot. Mr. <br />Patton confirlned there would not be any run off of vehicles from other cities and no velucles <br />will be stored in the city of north olmsted that are not from the city of north olmsted. Mr. <br />Tallon questioned if this could be a part of the motion. Assistant Law Director Dubelko <br />stated the purpose for the request is for the commission to determine whether a proposed use <br />(not a proposed business) is like and similar to other uses that are permitted. He noted it is <br />difficult to put conditions on it as typically the motion would be framed something like: "a <br />motion to approve permitting in the retail business districts businesses wluch provide <br />technology to remove dents from cars or businesses which consist of storing towed velucles." <br />Mr. Dubelko was not too concerned about Dent Wizard as the commission could say that tlie <br />particular use that they are permitting is the use of this service of removing dents with a <br />limited storage of cars, which from a legal standpoint would be easy to defend. He further <br />advised putting addirional conditions on a request it starts to appear more like a variance <br />rather than a like and similar use. Mr. Dubelko's main concem was, although it may work at <br />this location, if the commission approves this as a like and similar use and someone else <br />wants to go down Lorain Road in a less attractive place there might be difficulty in restricting <br />them if it has already been approved as a like and similar use in a General Business district. <br />Mr. Tallon wondered how the law department would recommend that the applicant pursue <br />this request. Mr. Dubelko advised it could be a variance request, however the most <br />appropriate route would probably be to amend the code legislatively if the city wants to allow <br />this type of faeility in restricted areas. Mr. Tallon was not concerned about the towing of <br />vehicles, but was mostly concerned about storage of the towed vehicles as that is something <br />that must be somehow restricted. Mr. Patton explained a wrecked vehicle may be stored at <br />this facility from 3 to 10 days, and so that there is never an over flow if anything is stored at <br />this facility longer than fifteen days the police department would be notified that vehicle was <br />being transported to another facility. Mr. Conway noted if a vehicle is abandoned and the <br />police department has it towed, but nobody claims it they have to hold on to it for about 180 <br />days and if it is not claimed then the title can be relinqu.ished. Mr. Patton explained an <br />abandoned vehicle is held for 10 to 30 days however in this type of situation the vehicle <br />would be towed to a larger facility. Mr..Dubelko maintained the best way to regulate this is <br />by legislation as it should be identified wliere this type of facility should be permitted. Mr. <br />Brennan stated this is a highly exposed area in the center oftown and he would rather see tlus <br />in a light industrial area. Mr. Tallon agreed and recommended if the police department wants <br />to pursue this idea that it be done legislatively and perhaps restricted to a light industrial area. <br />Mr. Tallon opened up discussion to the audience, but no interest was expressed. <br />R Tallon moved to deny the request of Patton's Towing, 4960 Dover Center Road, their request for determination that use is similar & permitted in General Business District. The <br />motion was seconded by T. Brennan and unanimously approved. Following the motion, Mr. <br />Tallon recommended that if the police department is really concerned about this situation that <br />they should get with their council people and legislate an area for this, such as light industrial <br />which planning commission would recommend
