Kovacek's intentions to be a good neighbor, but what if he decides to sell the business <br />will the next occupant have to comply with the same standards. He questioned if there would be trees <br />along the eastern edge of the property. Mr. Kovacek confuYned there would be enough trees to buffer <br />the residential area. Mr. Sowe also had concerns about compounding the flooding conditions. Mr. <br />Tallon explained the drainage will have to be addressed through the engineering department and any <br />water run off will have to be maintained on the site. Mr. Sowe questioned if they will have another <br />opportuuity to address this issue and was advised tlus request is for a conclitional use or allow this type <br />of business to go in this area. If the conditional use permit is granted, the building will still have to <br />come back later. Mr. Mills explained there is a process called spray booth that requires both fans to <br />circulate the booth and a water system that will take the particulate matter and remove it before there <br />is any exit into the atmosphere. He noted this facility will not have the same impact as the older <br />facilities because there are strict requirements that were not present years ago. Mr. Mills stated Mr. <br />Richey can answer any specific questions on this type of system. Mr. Tallon did not believe it was <br />necessary tonight but when this comes back for the building he would like a more detailed explanation.. <br />Mr. Richey mentioned that the paint booth industry is highly regulated as follows: 1) they are required <br />to submit a 23 page document as a pemut to install to the Ohio E.P.A.; 2) After the equipment is <br />approved for installation a 7 page document to operate the equipment; 3) the paint supplier must ... <br />submit documentation as to the amount of chemicals and particulate matter in their paint material. He <br />noted Mr. Kovacek, in an effort to be a good neighbor, has chosen to purchase a sophisticated piece <br />of equipment as the water wash filtration is generally used in industrial applications only. A resident <br />had trouble reading the drawing and was presented with an enlarged rendition. Mr. Nashar stated he <br />did not believe this use was considered retail. Mr. Conway advised the use is permitted if the <br />conditional use permit is granted which is the purpose of this meeting. He noted prior to 1991 it was <br />permitted, but in 1991 the city chose to restrict it a bit more to control the growth of them. Mr. <br />Tallon explained to the audience that this meeting is about whether or not the planning commission is <br />going to grant a conditional permit to allow this business to operate in the retail zoning. Mr. Mills did <br />not have anythiug further to present and announced he believed the nature of this type of business falls <br />within what the ord.inance would permit for a conditional use in this retail site. <br />R Tallon moved to grant Auto Body Services Inc., 28415 Lorain Road their request for conditional <br />use permit to operate an auto repair facility in a general retail district. The motion was seconded by R. <br />Koeth and unanimously approved. This request for conditional use permit is subject to cou.ncil <br />approval and will be heard by the B.Z.D. committee of council on Apri120, 1998 at 6:30 P.M. <br />N. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />A) Duke Realty (Corporate Center III) Amendment to Preliminary Land Use Plan <br />(Couutry Club Blvd.) <br />The presentation is for use by proposed Corporate Ceuter III, located on the north side of Country <br />Club Blvd., west-adjacent to Corporate Center I. Zoning is Mixed Use District Entirely. <br />Mr. Conway adviSed this case was slightly misdirected as it should not be an engineering issue or a <br />building department issue but is referred to council. He indicated this possibly should be placed in a <br />different spot on the agenda and offered to discuss this later in the meeting. Mr. Certo, architect, <br />presented the proposal and advised the materials will duplicate Corporate Centers I and U. The <br />members had no problem with this proposal.
