Vr . ? •V. <br />i <br />The proposal is to combine land designated as Permanent Parcel Numbers 236-19-008 and a <br />small adjacent portion of 236-19-011 into one (1) parcel. Location is south off Butternut <br />Itidge Road and north of Springvale Country Club. Zoning is A-Residence, Single entirely. <br />Mr. Delorenzo stated he purchased these parcels Biddulph Inc., prior to the cities purchase of <br />Springvale. He noted the deed was supposed to be transferred to him, but has never been <br />transfened. Mr. Delorenzo also advised there is another parcel in Olmsted Falls that the city <br />did not transfer the deed. He stated he has been paying the taxes on this land but has no deed. <br />Mr. Dubelko advised it is not a question of the city transferring ownership, as the city never <br />took this part of the parcel. This was part of a land swap involved in this transacrion and this <br />is a split owned parceL In other words,.he advised, this was excepted this out of the purchase <br />of Springvale. Mr. Dubelko clarif ed the property was never owned by the city of North <br />Olmsted, but is probably listed under the Delorenzo trust. Mr. Delorenzo argued when this <br />was filed it was supposed to go to the trust however since then the house has been transfened <br />from the trust into the Delorenzo name as this was once part of Biddulph Inc. It was noted <br />that Mr. Delorenzo cannot file the deeds because a lot consolidation is needed. Mr. Dubelko <br />stated this should have been done years ago. Mr. Delorenzo explained the deeds were given <br />to the city but never filed. W. Dubelko stated they could not be filed without a lot <br />consolidation. Mr. Delorenzo countered a lot consolidation or survey was not required at the <br />time this deed should have transferred. Mr. Brennan requested that Mr. Delorenzo identify <br />these to lots on the plan. Mr. Delorenzo identified the lots and noted this is the location of his <br />home. Mr. Brennan questioned if there were any legal issues on this consolidation. Assistant <br />Law Director Dubelko'stated he was not aware of any legal issues. The proposal was then <br />opened up for audience participation. Mr. Bradford stated he had a copy of the deed that was <br />filed for 236-19-011 which was filed immediately before the deed transferring ownership to <br />the city of North Olmsted. He noted the deed was obtained from the county records which <br />show that Biddulph Inc., transfened the properties into Delorenzo Trust prior to the sale to <br />the city of north olmsted. Mr'. Bradford further explained according to the deeds filed when <br />the city received ownership of the Golf Course, those deeds indicated that a plat was to be <br />filed. He noted no plat was ever filed. Mr. Bradford had concerns as Mr. Delorenzo is <br />attempting to develop the land behind his residence. He stated at the October 25, 1994 <br />planniug commission meeting it was agreed that Mrs. Delorenzo would receive the additional <br />property around the house in exchauge for transfer of a property in Olmsted Township to <br />Biddulph, Inc. Mr. Bradford noted the transfer of the property around the house was filed <br />with the county, however the deed transfer of the property in Olmsted Township cannot be <br />found. Mr. Delorenzo advised they are going through the same consol'xdation process in <br />Olmsted Township. Mr. Bradford clarified the transfer ofthis particular parcel was contingent <br />upon receipt of the property in Olmsted Township. He wondered if this should be transferred <br />without also transferring the property in Olmsted Township. Mr. Brennan advised the <br />planning commission is not examining the intricacies of the legal process and refened Mr. <br />Bradford's questions to the law department. Since the law department did not have any <br />concems about this consolidation, Mr. Brennan stated the commission has no choice but to <br />permit the consolidation. Mr. Bradford stated he was merely raising the point tliat if Mr. <br />Delorenzo gets the land he is supposed to get, then he is also supposed to get a portion of the <br />land. Mr. Dubelko stated there are problems with Olmsted Township which have nothing to <br />do with Mr. Delorenzo's request. Mr. Brennan advised the proposal is to consolidate the lots <br />and the commission is not ruling on any development plans at this time. <br />T.
