R. Tallon motioned to recommend approval of Ordinance 97-120, seconded by T. Brennan and
unauimously approved.
Ord. 97-121
Mr. McKay explained Building Commissioner Conway had requested this change as it makes it easier
for the building department to rule on such things as senior residences, assisted living facilities, etc.
Assistant Law Director Dubelko advised senior residence housing can be permitted with a conditional
use permit in single family residential, but also permitted as a matter of right in multi-family and retail
districts. He stated this proposed change makes sense. Mrs. O'Rourke questioned if this will effect the
Moran case. Mr. Tallon wondered where that type of facility would fall in this zoning change. Mr.
Dubelko advised the Moran case is currently in litigation and he was unsure where an adult care facility
would fall in conjunction with the zoning code.
R. Tallon motioned to recommend approval of ordinance 97-121 as presented; seconded by K.
O'Rourke and unanimously approved.
VI. COIVIlVIITTEE REPORTS: No items.
VII.
