4 <br />/ <br />CITY OF NORTH OLMSTED <br />"'TOGE7CHER WE CAlv MAKE A DIFFERENCEI" <br />BOARD OF ZONING APPEALS <br />AGElVDA -NOVEMBER 5, 1998 <br />1. ROLL CALL: <br />Chairman Gomersall called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman; R. Gomersall, Commissioners; J. Maloney, T. Koberna, J. Konold, and W. <br />Kremzar. <br />ALSO PRESENT: Law Director Gareau, Assistant Building Commissioner Rymarczyk, Assistant <br />Clerk of Commissions O'Connell, and Clerk of Commissions Rote. <br />H. DISPOSITION OF MiN-[JTES: J. Konold moved to approve the October 1, 1998 minutes as written. <br />The motion was seconded by J. Maloney, and unanimously approved. Motion Carried. <br />Chairman Gomersall advised that each case would be judged on the physical situation peculiar to <br />itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. <br />1. J. C. Hair Design Plus, 28813 Lorain Road: <br />Request for variance (1123.12). Proposal to convert existing garage into Hair Salon. <br />The following variances will be needed. <br />1) A variance to have a residential dwelling unit without a garage. <br />Which is a Violation of Ord. 90-125, Section 1161.08 (A-1). <br />2) A 5' foot rear set back variance for the building. <br />3) A 2' foot 6" inch front set back variance for the building. <br />4) A 5' foot west side yard variance for parking area. <br />5) A 8' foot front yard variance for parking area. <br />6) A 5' foot east side yard variance for land banked parking area. <br />Which is a Violation of Ord. 90-125, Section 1139.07. <br />Proposal heard by planning commission on September 22, 1998 at which time recommendations were <br />made to go before the board of zoning appeals. <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Ms. <br />Kopko, and Mr. Christou, who presented the proposal. Mr. Gomersall reviewed the variances being <br />requested, and asked if the garage is going to be expanded, or is it being converted into a salon. Ms. <br />Kopko indicated the garage will be converted, as well as adding the addition. Mr. Christou plans on <br />living in the home which is on the property, in addition he will have one maybe two tenants in the new <br />addition. Mr. Gomersall suggested Mr. Christou will have no garage on the property in which to park <br />his car. Mr. Gomersall indicated he had read over the planning Corrunissions minutes, which asked <br />that landbanked parking be included. Mr. Rymarczyk was asked how many parking spaces were <br />required. Mr. Rymarczyk suggested 10 spaces are required including the home tenant. Mr. Gomersall <br />asked about the south driveway which Planning commission asked to be 25' feet. Ms. Kopko <br />indicated it was changed so there is now a 25' foot radius that goes from the right of way to the curb. <br />Mr. Gomersall asked about the landbanked parking and suggested a fence be put in place as the <br />property abuts Child Time daycare. Mr. Maloney indicated a fence is not shown on the plans. Ms. <br />Kopko suggested she was unaware that a fence would be required. Mr. Maloney suggested one needs
