} <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />"TOGETHER WE CAN MAKE A DIFFERENCE!" <br />,L MINL7TES - SEPTEMBER 10, 1998 <br />I. ROLL CALL: , <br />Chairmau Gomersall called the meeting to order at 7:35 p.m. <br />PRESENT: Chairman R Gomersall, and Board members W. Kremzar, J. Konold, T. Koberna, J. <br />Maloney . <br />ALSO PRESENT: Law Director Ga.reau, Building Couimissioner Conway, and Assistant Clerk of <br />Commissions Rote. <br />II. DISPOSITION OF MINUTES: J. Konold moved to approve the August 6, 1998 minutes. <br />The motion was seconded by J. Maloney, and unaniinously approved. <br />Chairmau Gomersall advised that each case would be judged on the physical situation peculiar to <br />itsel? so that in no way is a judgment rendered considered to be a general policy judgment <br />affecting properties_ and like situations elsewhere. <br />Mr. Gomersall indicated he would like to change the order in which the cases are addressed <br />tonight. We will hear Castle Pines case first. Since there is no representative present for Castle <br />Pines at this time we will address each case in numerical order. <br />1. Dave Domann; 24062 Frank Street: <br />Request for variance (1123.12). Rear property less than 50' ft From new addition. Rear yard <br />setback to be 50' ft. 47' feet shown, requires a 3' ft Rear yard setback. Violation of Ord. 90-125, <br />Section 1135.08 (a). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to <br />Dave Domann. Mr. Gomersall read allowed the variance being requested and asked if there were <br />any questions from the board members. No further questions were asked. <br />J. Maloney moved to grant Dave Domami; 24062 Frank Street, his request for variance (1123.12) a <br />3' ft Rear yard setback. Violation of Ord. 90-125, section 1135.08 (a). The motion was seconded <br />by J. Konold, and unanimously approved. Variance Granted. <br />2. Tom Bryner; 2870 Clag;ue Road: <br />Request for variance (1123.12). Request a variance to construct a 12' X 16' shed in rear yard, on <br />the existing pavement behind garage. Due to configuration of the structure on the lot, rear yard will <br />support a shed of only 77 sq ft. Request 115. Sq ft Variance for size. Violation of Ord. 90-125, <br />Section 1135.02 (d-1) which allows a shed of 2% of the rear yard in square footage. <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Bryner. Mr. Gomersall reviewed the variances being requested, and asked Mr. Bryner to explain his <br />plans. Mr. Bryner indicated his house is a corner lot and the garage is attached to the house, so <br />when the footage was determined the measurement was taken from the back of the garage, and not <br />the house. The lot itself is very big, but the house is situated in an awkward way. Mr. Gomersall
