Due <br />to configuration of the structure on the lot, rear yard will support a shed of only 77 sq ft. Request <br />115. Sq ft Variance for size. Violation of Ord. 90-125, Section 1135.02 (d-1) which allows a shed <br />of 2% of the rear yard in square footage. The motion was seconded by T. Koberna, and <br />unanimously approved. Variance Granted. <br />3. Richard & Nanc,y Nallv; 5599 Revere Road: <br />Request for variance (1123.12). 1135.08 Rear set back shall be 50 ft Note: house is non conforming <br />rear setback is-46 ft. 1165.02 (B) (1) Alterations or enlargement of a non conforming Bldg. Will <br />require a special permit. <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Nally, and Mr. Jones, from Bennett Dover. Mr. Gomersall asked Mr. Conway if a 4' ft Variance <br />would be needed as it is not indicated in the request. Mr. Conway agreed with Mr. Gomersall that a <br />4' ft Variance was needed. Mr. Conway apologized for the clerks incomplete write up. W. <br />Gomersall informed Mr. Nally that his house is a non conforming building therefore a special permit <br />would be needed. No further questions were asked. <br />J. Maloney moved to grant Richard & Nancy Nally, 5599 Revere Road their request for variance <br />(1123.12) A variance of 4' ft Rear set back violation of 1135.08, and a special permit for a non- <br />conforming house which is in violation of (1165.02 (B) (1). The motion was seconded by J. Konold <br />and unanimously approved. Variance Granted. A$er the motion Mr. Conway addressed the board <br />members to clarify that Richard & Nancy Nally would need a 20' ft rear set back variance. He <br />explained that the write-up was inaccurate, and apologized for the mix-up. Mr. Gomersall indicated <br />that there is a big difference between 4' ft and 20' ft all we can do is go back and amend it. Mr. <br />Conway indicated the Building Department will notify Mr. & Mrs. Nally of the change. J. Maloney <br />motioned to amend Richard & Sally Nally of 5599 Revere Road to read the rear set back variance to <br />be 20' ft. The motion was seconded by J. Konold, and unanimously approved. Motion Amended. <br />4. Ra.vmond Beach; 23555 David: <br />Request for variance (1123.12). Request a variance to install a 456 sq ft Swimming pool and a 50 sq <br />ft Deck in liis rear yard. This will exceed 20% of the required rear yard by 114 sq ft A violation of <br />1135.2 (d) (2). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Beach. Mr. Gomersall read allowed the request being made. Mr. Koberna asked what the size of the <br />pool is. Mr. Beach suggested the pool is 16'x 32', above ground, and is oval in shape. No further <br />questions were asked. <br />J.
