?i <br />5. Timberview Homes; 5141 Porter Road: <br />Request for variance (1123.12). <br />1). Proposed lot does not comply with residence district B ininilnum width of lot 70 feet. Lot is 50' <br />feet wide therefor a 20' ft Variauce in width is required because developmeut does not coinply <br />with all other zoning regulations. Violation of Ord. 90-125, Section 1135.05 (a-1). <br />2). Proposed building does not comply with code ordinance "side yard shall be, on one side, not less <br />than 5' ft. Therefor a 2' ft Variance in south side yard requirements is required. Violation of <br />Ord. 90-125, Section 1135.07 (a). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Dunlap, and Mrs. Frank, a concerned neighbor. Mr. Gomersall asked Mr. Dunlap to review the <br />plans. Mr. Dunlap suggested we have tried to maintain 15' ft between both houses, but on the south <br />side yard we will need a 2' ft variance because of the porch. Mrs. Frank asked how far away from <br />her driveway would Mr. Duulaps house be. Mr. Dunlap suggested the driveway is 12' ft from your <br />property line. The reason we moved the house closer to the south side of our lot is because the <br />neighbor ou the north side of our lot is so close to their own property line. Mr. Gomersall asked why <br />the builder just doesn't move the house 2' ft to the north. Mr. Dunlap indicated the reason for <br />placing the house were the plans show is to maintain 15' ft between the houses, and to balauce the <br />houses. The house itself will be three feet shorter then the porch only the porch will be 2' ft into the <br />side yard. Mr. Gomersall asked then why don't you just end the porch at the corner of the house. <br />Mr. Dunlap indicated the porch is needed to give the house curb appeal, because that is what sells <br />houses. Mr. Gomersall suggested moving the whole house 2' ft to the north. Mr. Dtuilap suggested <br />he had spoke to the arclutect and the arclutect pointed out how close the house on the north side of <br />the lot was to their own property line. Mr. Gomersall indicated that is grandfathered so there is <br />nothing we can do about that. He asked Mrs. Frank to voice her concems. Mrs. Frank indicated she <br />is very worried about how close the house will be to her property. The builder will be selling this <br />house and what if the owners want to put up a fence, or what ever. Mrs. Frank doesn't want the <br />porch encroaching upon her yard, aud would like to request Mr. Dunlap stick to the code. Mr. <br />Gomersall suggested I would rather you move the house over 2' ft to the north. Mr. Kremzar <br />suggested only having the porch overlap by 1.5 ft past the front corner of the house. Mr. Conway <br />indicated if the house.to the north of this lot was conforming, Mr. Dunlap could move the house 5' ft <br />to the north and his house would be in compliance? so why not move the whole house 2' ft to the <br />north, there by putting the two non conforming houses closer to each other. Mr. Gomersall indicated <br />he thought that would be a good idea and asked Mr. Conway what size variance would be needed. <br />Mr. Conway indicated a 2' ft north side yard variance would be needed. No further questions were <br />asked. <br />J. Maloney moved to grant Timberview Homes; 5141 Porter Road: As amended and agreed upon, <br />their Request for variance (1123.12). 1). Lot size is 50' feet wide therefor a 20' ft Variance in width <br />is granted because development does not comply with all other zoning regulations. Violation of Ord. <br />90-125, Section 1135.05 (a-1). 2). A 2' ft side yard variance on the North side.of proposed lot. <br />Wluch is in Violation of Ord. 90-125, Section 1135.07 (a). The motion was seconded by J. Kremzar, <br />and unanimously approved. Variance Granted. <br />Chairman Gomersall asked if there was a representative present from Castle Pines. As Castle Pines <br />representatives were present, Castle Pines case was addressed. <br />3
