Request variance to have a Sth story on two buildings in middle <br />portion of property. Also request a variance for 88 spaces less than requ.ired by code. Violatiou of <br />Ord. 90-125, Sections 1138.05, 1138.06 and 1161.05. <br />Originally heard by Planning Commission May 9, 1995, and Heard by Architectural Board of Review <br />oji May 17, 1995. NOTE: Identical proposal was heard by the Board of zoning appeals May 15, <br />1995 however order expired in accordance with section 1123.15. Reheard by plauniug on <br />September 8, 1998. <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Corey, Mr. Kaczniar, the Architect, and Ms. Balogh, a concerned neighbor. Mr. Gomer•sall <br />reviewed the variances being asked for. He indicated that most of tonight's members were on the <br />board when this case was heard in 1995 there was a lot of questions the board had then. Has there <br />been any changes made since the case was before this board in 1995. Mr. Corey indicated there was <br />one change, iu 1995 we didu't own one of the parcels of land that we now own. Mr. Conway <br />suggested they have submitted blue prints tonight that address most of the questions from Tuesday <br />nights Planuiug commission meeting. They have provided land bank parking, it is not a paved area <br />but is land banked and cau be utilized in the future. Mr. Gomersall asked Mr. Corey if he had <br />anytlung to add to Mr. Conway's statement. Mr. Kaczmar indicated the construction is a pre-cast <br />plank system, wluch meaus there is only 8' ft clear space within each of the units and is an 8 foot 8 <br />iuches floor height. The over all height of the building is not five story's. Mr. Gomersall indicated <br />the board members have a rough draft of the Castle Pines minutes from the Plauuing commission <br />meeting dated 9/8/98, the bottom line of the motion is to approve the plans as they are, and I sees uo <br />other reason for this board to do otherwise. Mr. Goinersall asked if there were any further questions <br />from residents. Ms. Balogh a neighbor indicated she had not seen the plans since 1995 when they <br />were submitted and would like to look at them. Mr. Corey addressed Ms. Balogh's questions and <br />reviewed the blue prints with her. Ms. Balogh indicated she did not have any objections to the new <br />plans. No further questions were asked. <br />J. Maloney moved to grant Castle Pines of 30338 and 30374 Lorain Road. Their request for <br />variance (1123.12). 1). Michael Homolak; 5647 Whitehaven: <br />Request for variance (1123.12). Requesting a variance to install a swimming pool in the rear yard <br />that exceeds 20% of the required area of the rear yard by 265. Sq ft Which is a Violation of Ord. 90- <br />125, Section 1135.02 (d-2). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Homolak. Mr. Gomersall reviewed the variances being requested and asked Mr. Homolak to indicate <br />if he agreed with the request that was just read aloud. Mr. Homolak indicated the notice that was <br />sent out is wrong, we are not 265' Sq ft over we are 176' Sq ft over. Mr. Gomersall asked Mr. <br />Conway to add.ress Mr. Hamolaks square footage issue. Mr. Conway asked Mr. Homolak how he <br />reached his figures of 176' Sq ft. Mr. Homolak indicated he spoke to the inspector every day for a <br />week on the phone and together we came up with 176' Sq ft. Mr. Conway suggested some times just <br />discussing the figures over the phone is difficult. Mr. Conway showed Mr. Homolak the calculations <br />4
