Mr. Gomersall read aloud the different variances being <br />requested. Mr. Bomstein reviewed the location of were the existing pole sign is located, that <br />will be removed, and were the new monument sign would be placed. Mr. Gomersall stated I <br />reviewed the Planning Commissions minutes and they recommend the request be granted, and <br />I see no reason to disagree. <br />T. Koberna moved to grant Dunking Donuts, 26963 Lorain Road their request for a Special <br />permit (1123.11), (A). A special permit to add to a non-conforming bu.ilding. (B) A special <br />permit requ.ired Ord. 90-125, Section 1165.02. (C) A request for variance (1123.12). <br />(D) The following variances for the expansion of non-conforming building: <br />1) a 7 foot side yard setback variance (10 feet is required 1165.02); and <br />2) a 38 foot variance for front yard setback (75 feet required 1139.07) <br />(E) The following signage varia.nces: <br />1) a variance to place a ground sign in the 35 foot triangle (1163.12-B); <br />2), an 8'6" setback variance for the directional signs (1163.12-E); and <br />Note: They are now only 1 foot 6 inch from the right of way and are requ.ired to be 10 feet. <br />3) a variance to have two corporate names on the free standing sign, where as the code <br />.' permits only one for a business build.ing (1163.12-M. <br />Violation of Ord. 90-125, Section(s) 1165.02, 1139.07, 1163.12-13; 1163.12-E, and 1163.12- <br />H. The motion was seconded by J. Molony and unanimously approved. Variances Granted. <br />2. Schirmer Construction, 3135 Industrial Parkwav: <br />Request for variance (1123.12). Request a variance to have storage areas outside of enclosed <br />buildings (1145.09-A); and a six (6') foot variance for width of driveways (1161.10-B). <br />Violation of Ord. 90-125, Section(s) 1145.09-A and 1161.10-B). Note: A 30 feet wide drive <br />is being requested and 24 feet is allowed by code, but the Fire Department recommends a <br />width of 30 feet. Note: Heard by planuiug commission 03/24/98 and by architectural review <br />board 04/22/98. <br />Chairman Gomersall called all interested parties before the board. The oath was admiuistered <br />to Tony Cerny, and Red Sclurmer. Mr. Gomersall reviewed the variances being asked for. <br />Mr. Cerny stated the driveway variance we are asking for is because of the big equipment that <br />we use, it needs plenty of room, and the fire department would also like the drive to be 30ft.. <br />The second issue is on the buildiug which is a three sided building, meaning the back side will <br />be left open for storage of eqttipment for weather protection. On the back end of the property <br />there is a CEI easement, we will be placing mounds across the back area, as well as planting <br />trees. Mr. Molony commended Schirmer for such a well thought out plans. Mr. Kremzar <br />inquired about the safety of the gas pumps. Mr. Cerny reassured board members they would <br />be well protected. <br />J. Molony Moved to grant Schirmer Construction, 3135 Industrial Parkway (A). A variance <br />to have storage areas outside of enclosed buildings (1145.09-A); (B). A six (6') foot variance <br />for width of d.riveways (1161.10-B). Violation of Ord. 90-125, Section(s) 1145.09-A and <br />1161.10-B). The motion was seconded by T. Koberna and unanimously approved. Variances <br />Granted.
