Request the following variances to replace damaged shed: <br />1) a 20 square foot variance for size (1135.02 D-1); <br />2) a six (6) foot variance for intrusion into the side yard (1135.02 D-1); and <br />3) a five (5) foot variance for side yard setback variance (1135.02 D-4). <br />' Violation of Ord. 90-125, Sectiou(s) 1135.02 D-1 and 1135.02 D-4. <br />Chau7nan Gomersall called all interested parties before the board. The oath was admiuistered <br />to Randy Dougall, and Laura Dougall. Mr. Gomersall informed Mr. Mrs. Dougall that it was <br />against code to just rebuild their shed over the same cement pad that the previous shed was <br />attached to, you should have checked with the building department to see if this would be <br />allowed. Mr. Koberna inquired if the reason for removing the old shed was because it was <br />damaged. Mr. Dougall stated I was not aware that I was breaking the code when I replaced <br />the old shed, it was only replaced because the falling,trees damaged the old shed. Mr. <br />Gomersall advised that?anyone doing work should check with the building department to make <br />sure it is within code. <br />T. Koberna Moved to grant Randy Dougall, 26147 Tallwood Drive the following variances to <br />replace damaged shed: <br />1) a 20 square foot variance for size (1135.02 D-1); <br />2) a six (6) foot variance for intrusion into the side yard (1135.02 D-1); and <br />3) a five (5) foot variance for side yard setback variance (1135.02 D-4). <br />Violation of Ord. 90-125, Section(s) 1135.02 D-1 and 1135.02 D-4. The motion was <br />seconded by J. Konold and unanimously approved. Variances Granted. <br />4. Bur eg r King, 26270 Lorain Road: <br />Request Special permit (1123.11)Request a special permit to add to a non-conforming <br />building. Special permit required Ord. 90-125, Section 1165.02. Request for variance <br />(1123.12). Request a six (6") inch rear yard setback variance (50'0" required). Violation of <br />Ord. 90-125, Section 1139.07. <br />Chairman Gomersall called all interested parties before the board. The oath was administered <br />to Randy Showalter, and Bob Clemons Project Manager. Mr. Gomersall reviewed the request <br />being asked for and stated I have no problems with this request is there any questions from <br />other board members. There were no further questions. <br />J. Molony Moved to grant Burger King, 26270 Lorain Road (A) a special permit to add to a <br />non-conforming building. Special permit required Ord. 90-125, Section 1165.02. Request for <br />variance (1123.12). (B) A six (6") inch rear yard setback variance (50'0" requ.ired). <br />Violation of Ord. 90-125, Section 1139.07. The motion was seconded by J. Konold and <br />unanimously approved. Variances Granted. <br />5. Christian Chapel, 4757 Clague Road: <br />Request for variance (1123.12). Request a variance to have twenty-four (24) parking spaces <br />less than required by code. (Code requires 1 per each 2.5 seats) Violation of Ord. 90-125, <br />Section 1161.05 (G). Note: Heard by board of zoning appeals 10/01/97. <br />Chairman Gomersall called all interested parties before the board.
