<br />CTTY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES -RESCHEDULED MEETING <br />FEBRUARY 11, 1998 - 7:30 P.M. <br />Vice-Chairman Maloney called the meeting to order at 7:40 P.M. <br />Present: J. Konold, T. Koberna, W. Purper, and J. Maloney. <br />Absent: R. Gomersall. <br />ALso Present: Law Director Gareau, Assistant Building Commissioner Rymarczyk ; and Clerk of <br />Commissions Cornish. ` <br />W. Purper moved to approve the December 3, 1997 minutes, seconded by T. Koberna and <br />unanimously approved. <br />Mr. Maloney stated there are six cases on tonight's agenda which include: two cases involving <br />sheds, twa regarding signs, one lot depth and one superstore. He advised each case tonight is being <br />heard on it's own merit. It does not set the criteria for other cases. The sign ordinance 90-125 of <br />the City of North Olmsted was effective in May 21, 1991 and approved by the City CounciL This <br />was in line with a Master Plan by the city to clean up a lot of clutter and improve the city image. At <br />that time, they gave business an opportunity to come in compliance by January 1, 1998. That was <br />seven years to come in coxnpliance. As business came before the planning commission and other <br />commissions including the board of zoning appeals, they tried to come in compliance and work with <br />the City of North Olmsted. A few examples are: Lazy Boy Chair; Marty's Living Room Furniture, <br />St. Clarence Church, Realty One, The Donut Connection, Spremullie Marathon Gas, Infiniti Auto, <br />Smythe Cramer, and many others. The concerns that have come into compliance did it in the <br />SPIltIT OF COMM[JNITY COOPERATION. On the other hand, there are a group who are <br />bulkiug about coming into compliance. How can a business hire an architect to redesign store fronts <br />and layouts for business buildings, landscape and not have the foresight of bringing the business sign <br />in compliance. Why would owners of business bulk at following the codes as prescnbed in the <br />master plan and ordinances of the City, and spend thousands of dollars for their establishments in the <br />City? Personally, I commend our Mayor and Council Persons for having the foresight back in 1991 <br />to pass ordinances that will beautify the City. I encourage businesses and architects also to get on <br />board and cooperate. <br />1. Richard RusselL 27942 Marquette Blvd. <br />Request for variance (1123.12). Request 24 square foot variance for area of proposed shed that <br />exceeds 2% of rear yard area. Also, request 9 foot, 6 inch variance for location of shed from rear <br />property line. Violation of Ord. 90-125, Sections 1135.02(d)(1) and (d)(4). <br />Vice-Chairman Maloney called all interested parties before the board. The oath was administered <br />to Mr. Russell, who explained the proposaL The members had no problem with this request. <br />W. Purper moved to grant Richard Russell, 27942 Marquette Blvd., his request for a 24 square <br />foot variance for area of proposed shed that exceeds 2% of the rear yard area. Also grant a 9 <br />foot, 6 inch variance for location of shed from rear property line. Violation of Ord. 90-125, <br />Section 1135.02 (d)(1) and (d)(4). The motion was seconded by J. Konold and unanimously <br />approved. Variance granted.
