Latina & Latina Builders (Hvmau Builders), Property located between Tree Lane, Woodview <br />Drive and West 231 Street. <br />Request for variance (1123.12). <br />Request a blanket 5 foot rear yard variance for 16 additional lots of the 551ots in this subdivision <br />(Minimu.m rear yard depth is 50 feet) for sublots 6 through 8, lA through 7A, 21 through 24, 27, <br />and 32 all. S/L 6 through 8, lA through 7A, 21 through 24, 27, and 32 on Bridgeport Drive. <br />Note: 18 other sublots of the SS lots were granted 5 foot rear yard variances on 12103/97. <br />Vice-Cha,irnLan Maloney called all interested parties before the board. The oath was administered <br />to Mr. Latina, Mr. Sandercock, Ms. Wilkins, Mr. Baddour, and Mr./Mrs. Vamospersci. Mr. <br />Latina explained the proposal. Mr. Purper stated he has been on this board over six years and one <br />of the pet peeves has always been when someone comes and asks for a variance and a month later <br />they come back and ask for more. At the last meeting Mrs. Latina presented what she wanted and <br />received a variance, yet a month later they aze asking for more. Mr. Purper explained this was <br />discussed for about one hour at the last meeting and now it seems nothing was accomplished. Ms. <br />Wilkins advised although the intent was to include these lots, that was not part of the request at <br />the last meeting because the application was completed inconectly. Mrs. Latina requested that <br />the lots be considered at the last meeting and was told they could not as legal notice was not given <br />for the lots they wanted to add. Law Director Gareau stated Mrs. Latina requested that three <br />additional lots be included with her request at the last meeting and now the request has grown to <br />16 lots. Mr. Purper questioned, if Latina will come back ne7ct month requesting more if this <br />request is approved. Mr. Latina assured the board they would not be back requesting additional <br />variances. Mrs. Vamospersci was concerned that the homes would be too close together. She <br />advised although her home has a 45 foot rear setback, the land where Mr. Latina is building is at a <br />-higher elevation. Several people were tallflng at the same time, and Mr. Gareau advised them to <br />speak one at a tune and direct there questions to the chairman. Mr. and Mrs. Vamospersci stated <br />they were not notified of the previous meeting and Mr. Koberna advised they were notified as <br />their name appears on the list. Mrs. Vamospersci advised the houses would be to close together <br />as her rear setback is also 45 feet. She also noted the land is elevated where these new homes are <br />being built thereby causing a flooding concern. Mr. Latina advised this is something Mrs. <br />Vamospersci should talk to the City's Engineering Department about as that is how it was <br />approved. Mr. Sandercock advised at the last meeting a ten foot rear yard variance was <br />requested, however, during the course ofthe meeting a five foot rear yard variance and a five foot <br />front yard variance was discussed, and finally it was decided to grant a five foot rear yard <br />variance. He advised the homes on West 231st street all have 40 foot frontage and Latina is <br />asking for a 45 foot frontage. Mr. Ryinarczyk stated the request is for a rear yard variance as the <br />front yazd will conform to code. Mr. Sandercock explained granting a 45 foot variance will make <br />these new homes compatible to the homes in the surrounding area. He stated the development <br />area is constructed to direct water to the storm sewers. In response to a question from Mr. <br />Purper, Law Director Gareau advised the boazd could approve sixteen additionallots. <br />7. Maloney moved to grant, Latina & Latina Builders, (Hyman Builders), Properry located <br />between Tree Lane, Woodview Drive and West 231 Street a blanket 5 foot rear yard variance for <br />16 additional lots of the 55 lots in this subdivision (Miuunum rear yard depth is 50 feet) for <br />sublots 6 through 8, lA through 7A, 21 through 24, 27, and 32 all. S/L 6 through 8, lA through <br />7A, 21 through 24, 27, and 32 on Bridgeport Drive. Note: 18 other sublots of the 551ots were <br />granted 5 foot rear yard variances on 12/03/97.
