<br />R. Tallon motioned to approve Chi-Chi's Mexican Restaurant of 26410 Great Northern Shopping <br />Center their proposal, which consists of painting the exterior building, with no objections from the <br />Planning Commission. Chi-Chi's will go to the Architectural Review Board and if there are no <br />major changes made the proposal will not.have to return to the Planning Commission a second <br />time. The motion was seconded by T. Brennan and Unanimously Approved. Note: Following the <br />motion the clerk announced the date, time and location of the next Architectural Review Board <br />meetmg. <br />2). Developers Diversified (Babies "R" Us)26520 Lorain Avenue: <br />Proposal consists of renovating the exterior building of the former Best Products building. Note: <br />the Planning Commission on September 14, 1999 heard this proposal. The Architectural Review <br />Board reviewed this proposal on, September 22, 1999 and October 20, 1999. <br />Chairman Tallon called all interested parties forward to review their proposal. Mr. Blair, with <br />Developers Diversified, came forward to review the request. Mr. Blair indicated that the <br />Architectural Review Board has approved the modifications that have been made. At the <br />previous meeting the fence was a concern, the fence has been inspected and it is in good shape. <br />The fence will be maintained by Developers Diversified. It has been found that people were <br />removing slats out of the fence to cut through to the mall. The cut sheets for the lights were <br />submitted for the board's approval. There will be wall packs with shields, which will keep the <br />light from shining into the resident's homes. Mr. Blair presented the board with picture of the <br />exiting fence so that the board members could see the shape it is in and remarked that the slats <br />would be screwed in place to detour future vandalism. Mr. Brennan suggested the applicant <br />review the dumpster area as well as deliveries. Mr. Blair commented that the dumpster area will <br />be in the rear of the building, there will be a sound barrier put in place that will match Home <br />Depot's. Mr. Brennan questioned the concern that was brought up regarding truckers using the <br />back area for a sleepover and leaving their trucks running all night. Mr. Blair suggested that once <br />the building is occupied they believe that the truckers will no longer use the area for a rest stop. <br />The signs will be posted and there will be no truck deliveries at night. Mr. Brennan questioned if <br />there would be a responsible party for the residents to call if they see trucks parking all night in <br />the back of the building. Mr. Blair suggested that the District Manager for Babies `R' Us would <br />be giving out his number to the surrounding neighbors so they can contact him directly with their <br />concerns. There will also be an operational manager at the site that will be available. Mr. Tallon <br />questioned the Building Commissioner as to what the delivery hours were by code. 1VIr. Conway <br />commented that he would need to look the exact hours up, but the ordinance by law has to be <br />posted in the rear of the building. Mr. Tallon suggested that he thought 10:00pm was too late for <br />deliveries. Mr. Brennan remarked that in less the management stands firm with regards to not <br />allowing the trucks to park in the back of the building it will not detour the trucker's from parking <br />all night. Mr. Blair indicated that when a complaint is received at their main office, they would <br />contact the store manager and put them on notice that they are breaking the law and that they <br />must address the issue right away. Mr. Conway questioned if the applicant would add wording in <br />the lease addressing enforcing the code. Mr. Blair suggested that Developers could send a letter <br />to the tenant's letting them know the issue would need to be addressed and they could also amend <br />the lease as it has already been signed. Mr. Conway questioned if the Law Department could be <br />sent something in writing for them to review. Past practice has shown that calls are made and for <br />2
