.?? <br />-r <br />behalf of the Councilmen that were not present is that once someone comes in and applies for <br />development they are locked into using it for what it is zoned. If this ordinance is denied here, <br />Council can still proceed they just have to have a grater majority to pass the ordinance. They will <br />also have to have a public hearing at which time the owner of the property will be notified and he <br />would have say about down grading his property. Mr. Brennan questioned where the lot was <br />located. Mr. Dubelko indicated that the lot in question was an empty lot located west of bridal <br />wood and abuts highway 480. Mr. Tallon suggested the lot would be good for single family <br />cluster, but was unsure if it should be rezoned now or when the Master Plan is reviewed. Mr. <br />Koeth indicated that he thought rezoning af the lot should be done when the 1Vlaster Plan is <br />reviewed. Mr. Brennan commented that he was concerned that Councilman McKay might be <br />proposing this ordinance because of talk about the lot being developed mixed use. Mrs. <br />O'Rourke agreed with Mr. Brennan. Mr. Brennan suggested that if there were talk then he would <br />like to see the zoning changed now. Mr. Spalding suggested tabling the ordinance until <br />Councilman McKay could address the board. Mr. Brennan suggested that by the time <br />Councilman McKay came before the board there could be a proposal submitted. Mr. Spalding <br />questioned if Mr. Dubelko knew of any developer talking about submitting aproposal. Mr. <br />Dubelko indicated that as this lot is mixed use there could be a lot of things built on mixed use. <br />He believed that a year ago there vvas a lot of concern regarding tlus lot, as there was talk of a <br />developer submitting plans. N1r. Ta11on indicated that he was concerned about the timing of the <br />ordinance. He feels the lot is a good area for single family cluster. Mr. Deichmann indicated that <br />last year he looked at a proposal for a multi-apartment building. In the past 6 months there has <br />been inquires regarding this lot also. Mr. Tallon commented that with than in mind then maybe <br />the board should address the rezoning now. Mr. Spalding suggested that Bowers proposal was <br />turndown because the lot was- zoned A residential as well as the surrounding homes. Mr. Tallon <br />indicated that he never bases his opinion on whether or not a parcel is A, B, or C. He reviewed <br />that the cluster homes that were proposed by bower were bigger and more costly then the existing <br />homes that would surround them. They were not compatible to the area. In the Master Plan the <br />board has tried to keep the cluster homes on the commercial side with a residential background as <br />a buffer. Mr. Hreha questioned if single family residents were to the west of the parcel. Mr. <br />Brennan suggested that if the zoning was outdated then the Planning Commission should change <br />the zoning of the parcel. W. Spalding suggested that he was not really in favor of cluster <br />developments. Mr. Hreha questioned what mixed use allowed. Mr. Dubelko reviewed that mix <br />use is large pieces of undeveloped property in which proposals are usually a combination of muti- <br />family or offices. At least that is what it has been in the past historically for North Olmsted. A <br />number of years ago the chapter was amended to provide for some retail use, if they are <br />compatible with the overall development of the parcel. Mr. Dubelko commented that he did not <br />think it was a question of waiting for the next Master Plan. He believes it is a question of <br />assisting Council in implementing recommendations from the last Master Plan. <br />R. Tallon motioned to approve the adoption of Ordinance No. 99-127. The board will review the <br />parcel again during the review of the Master Plan. Note: In the framing of the motion the board <br />requested that the adoption was subject to the parcel meeting all the requirements of the single <br />family cluster ordinances. The motion was seconded by T. Brennan and unanimously approved. <br />Motion Carried. <br />7
