<br /> <br />in the area is that they are bigger than the average lot size found in North Olmsted. He hopes <br />that the Bowers will protect the valued green space. He would like to see the Bower's prosper <br />but ask that they look at putting in a triplex where hole 2 currently is as it is a very short hole. <br />In the new parcel they could put in a nice golf hole which would give a higher value to the area. <br />He asked the board to review what the procedures for the bowers would be. He questioned <br />Fred Bower about the property, wluch was about a lOfoot strip that he owned, if it would have <br />anything done to it. He indicated that he was not sure if his next comment was relevant or not <br />but in or about 1956 or 1958 the existing creak just about did over flow. Mr. Levanoff <br />indicated that he and his wife had only lived in their home for three months and now their <br />backyard is going to be filled with cluster homes. He likes North Olmsted and has lived here his <br />entire life. This proposal takes away from his house and takes away from what we think North <br />Olmsted is. He wants the board to know how the residents feel about the proposal. Ms. <br />Harvey indicated that she has lived on Louis Drive for a long time and has known the Bower <br />boys for a long time. She indicated that Neil Bower's children road their horses to her home <br />and enjoyed the same luxuries the children today currently have today. She is happy for their <br />success but disagrees to add cluster homes would be too much. She asked the Bower brothers <br />to build signal family homes that would enhance Louis Road. Ms. Morgan indicated that the <br />Bowers were very evasive with their answers to the question of what would happen to the <br />house Fred Bower owns. She is concerned that the home is vacant as children could start <br />vandalizing and hanging out around the house. The residents should have an answer as to if the <br />house will remain empty. Mr. Tallon indicated that as far as he knew there was no law against <br />having an empty home as long as it is maintained. It is up to the property owner to maintain <br />his/her property and make sure it is not a safety hazard. If it does become a safety hazard the <br />police should be notified. Mr. Celebrezze questioned what the determining factor was as to <br />who is notified and who is not. Mr. Dubelko indicated that the code indicates that all those <br />lands that abut the parcels in question. He believed that the residents listed on the notice were <br />those who abut the property in question. There may be concerns about notifying the owner of <br />the golf course as he is related to the owrier of the proposal, but that is what the City laws <br />provide. He indicated that Donna Rote who is the Clerk of Commissions, has the job to give <br />legal notice in accordance to the law. Mr. Dubelko further commented that he believed the <br />clerk had given proper notice. Mr. Celebrezze questioned why the residents on the opposite <br />side of Fitch Road were notified. Mr. Conway indicated that roads and streets are looked at as <br />if they are not there. So the 480 is treated as if it is not there. Mr. Celebrezze questioned if the <br />State was notified as they own 480. The clerk indicated that she did not notify the State as 480 <br />was treated as it didn't exist. Mr. Celebrezze questioned the clerk as to if that was a <br />requirement of any kind to notify a property owner, which in this case is the State of Ohio. Mr. <br />Dubelko suggested that he would not give an oflFthe cuff opinion on that issue without looking <br />into it, if that is an issue that is raised he would look into it for the corrunission. IVIr. Celebrezze <br />questioned if Mr. Dubelko would consider that an issue raised by him. Mr. Dubelko <br />commented that he would look into the issue for Mr. Celebrezze. Mr. Dubelko indicated that <br />presently this is a proposal to develop it would culminate into a rezorung if the proposal is <br />accepted. One of the gentlemen who came forward earlier asked for the procedures. The <br />procedure is that anyone that owns property can apply to develop it as single family cluster, as <br />long as the size requirements like acreage is met. That is what this owner has done. The <br />function of the Planning Commission is to review the chapter of the code, which deals with <br />18
