? i. <br />.? <br />doesn't fit into the master plan for the city. The Planning Commission is basing their decision <br />on the impact it would have to the surrounding neighborhoods. <br />R. 'I'allon motioned to not allow the rezorung of the property as it could be developed with class <br />A homes. Mr. Conway indicated that the plans before the board were not for rezoning, but for <br />the development of cluster homes. Mr. Dubelko indicated that cluster development proposals <br />were different then most proposals. Chapter 1136.12 which deals with cluster developments <br />indicates that the board is supposed to receive reports from the Engineering Department, <br />Building Department, Safety Department and the Law Department prior to the proposal being <br />addressed. He questioned if the board members had received such reports. If not, he did not <br />think the Planning Commission should make a motion on the proposal at this meeting as the <br />board didn't have the information before them torught. Mr. I3ubelko indicated that that the <br />board has to follow the laws of the city. Mr. Dubeiko reviewed what was required to review <br />the cluster proposal. Mr. Spagnuolo asked if the residents could get a copy of the reports. Mr. <br />Dubelko indicated that they could as they would be public documents. Mr. Spagnuolo <br />questioned what the reports would be based on. Mr. Dubelko reviewed what the reports would <br />be based on. A gentleman form the audience commented that if the board voted to not rezone <br />the parcel, why can't that be the end of it. Mr. Dubelko commented that it is never a good idea <br />to not follow the City's laws. Mr. Tallon commented to the clerk to strike his motion. <br />R. Tallon motioned to have the Building Commissioner request reports from the Building <br />Department, Engineering Department, Safety Department, and the Law Department and that <br />the cluster proposal be tabled until the next Planning Commission meeting. The motion was <br />seconded by T. Brennan and unanimously approved. <br />IV. NEW 17EVELOPMENTS AND SLTBDIVISIONS: <br />Foreman; Consolidation Plat: <br />The proposal is to combine permanent parcel Nos. 235-14-007; 008, and 235-14-009 (formerly <br />different owners) located on the east side of Burns Road south of Midvale Avenue, into one (1) <br />parcel. Zoning is "B"-Residence, Single entirely and proposal conforms to Zoning Code <br />Requirements for lot area, frontage, and depth. <br />Acting Chairman Brennan called all interested parties forward to review the request. Mr. & Nlrs. <br />Foreman came forward to present their proposal. Mr. Brennan asked Mr. Foreman to review the <br />reason for his request. Mr. Foreman indicated that he would like to combine the two lots, as the <br />vacant lot was not useable because of the easement, wluch ran down the rruddle of the lot. They <br />were informed they could not put a fence on a vacant lot. They purchased the lot last year and <br />had the horne removed. Mr. Brennan commented that the applicant would just be enlarging his <br />yard and fencing it in. The lot conforms to the zoning codes and the commission has no <br />objections to the request. He asked if there was anyone in the audience that had concerns with <br />the request. No further comments were made. <br />20
