<br />? <br />T. Brennan motion to approve the Foreman, Consolidation Plat which consists of combining <br />permanent parcel Nos. 235-14-007, 008, and 235-14-009 (formerly different owners) located on <br />the east side of Burns Road south of Midvale Avenue, into one (1) parcel. Zoning is "B"- <br />Residence, Single entirely and proposal conforms to Zoning Code Requirements for lot area, <br />frontage, and depth. The motion was seconded by W. Spalding and unanimously approved. <br />Motion Granted. <br />V. COMMUNICATIONS: <br />The Planning Commission will need to review the following ordinances: <br />1). Ordinance No. 99-106: An ordinance creating new section 1139.12 of the North Olmsted <br />Zoning Code regulating the location of free-standing industrialized units on commercial property. <br />2). Ordinance No. 99-109: An ordinance creating new section 1139.13 of the North Olmsted <br />Zoning Code regulation outdoor, enclosed storage of motor vehicles at motor vehicle repair <br />facilities. <br />3). Ordinance No. 99-110: An ordinance creating new section 1119.06 of the North Olmsted <br />Zoning Code requiring that developers report certain income tax information to the city prior to <br />obtaining occupancy permits following commercial construction or new residential construction in <br />the city. <br />VI. CONIIVIITTEE REPOR'I'S: <br />VII. MINOR CHANGES: <br />VIII. NEW BU5INESS: <br />IX. OLD BUSINES S : <br />Mr. Tallon asked the representatives from Mill Garden Condominium to come forward. Ms. More <br />indicated that see was the secretary for the Mill Garden Condominiums and had lived in her <br />condominium for over 20 years as well as the other condo owners. Ms. More read allowed a <br />letter that was submitted to the clerk. (Said letter is attached to the back of these minutes). Ms. <br />Mr. Tallon questioned if the condominium members knew that the Olmsted Mannor proposal had <br />already been reviewed and passed. Ms. More indicated that none of the condo owners had been <br />notified. Mr. Tallon indicated that he assumed that was why the representatives were present. He <br />indicated that the clerk would have to check the files, as the board members did not presently <br />have the case file before them. Mr. Tallon indicated that the clerk would check the case file and <br />the Law Department would make a ruling on whether the contact list was correct or not. Ms. <br />More indicated that there was not one condo owner that was notified and she believed that <br />anyone within 500 feet of the proposal property should have been notified. Mr. Tallon reiterated <br />his earlier comment that the clerk would check the files. Ms. More asked if anyone could tell her <br />who was notified. The clerk indicated that she did not presently have the case file before her, but <br />she would check the file and Ms. More was welcome to a copy of the notices that were sent out. <br />21
