??. <br />? <br />Ms. More again commented that no one in the concios were notified. She commented that both <br />1VIs. Polito and Kathy commented that they had not received any type of notice. Ms. More <br />indicated that Kathy was asked by the architect to come and pick up blueprints just last week and <br />that is when we found out about the proposal. Councilman O'Grady asked to speak. He <br />suggested that any time there is a new development the primary concern has to be the impact on <br />the existing resident. The woman present tonight are concerned about their drainage, they have <br />fought battles in the past with water, and are concerned there will be added water problems. <br />Their concerns are justifiable as the proposed building will be only 25 feet from their property. <br />The question is notification, he asked Assistant Law Director, Dubelko if the condo owners were <br />not notified properly then what would the status of the permit be. Mr. Dubelko indicated that if <br />the property owners were not properly notified, then the City should rehear the case as residents <br />are interested parties. The residents are entitled to notice and if they are not it could bring an <br />action against the City that would delay the whole thing. There would be a strong look at <br />rehearing the case if proper notice was not sent. The clerk will forward the facts to the Law <br />Department and he would make a ruling. Mr. Dubelko indicated that notification was not 500 <br />feet, but was any property that abuts the property in question. The clerk indicated that the <br />Planning and Zoning Code indicates that it is any property thai abuts the parcel in question. Mr. <br />Dubelko suggested that 1VIs. Nlore could be thinking of the rezoning as rezoning requires notices <br />to anyone within 1,000feet. Development plans the code provides that any abutting property <br />owner be notified. Ms. More the association was not aware of the proposal until September 7, <br />1999 as no one was notified. Mr. Dubelko indicated that the clerk would look into the facts and <br />forward them to the Law Department. Mr. Tallon thanked the women for coming. No further <br />comments were made. <br />X. ADJOURNMENT: <br />Mr. Tallon indicated that due to the lateness of the meeting the ordinances would be tabled until <br />the next meeting and the meeting would be adjourned.
