Mr. Elbin suggested that he understood the concerns of the abutting residents. They are the <br />new owners and he feels that their maintenance level will be above what was there before. I3e <br />indicated that he would take a closer look at the fence to make sure it was in good shape. He <br />suggested that there were not pole lights, only wall safety packs, but he would look into toning <br />down the wattage. He believes the truckers Mr. & Mrs. Vine is talking about truckers that are <br />just using the site as a place to rest. Mr. Vine indicated that some of the truckers were just <br />using the site, but that the delivery trucks were just as bad. Mr. Dubelko commented that he <br />would like to make a couple of points from the Law Departments perspective. There is a new <br />change in the code with respect to running truck engines subsequent to or after deliveries and <br />the residents may want to talk to the building Department to review the codes. Mr. Conway <br />suggested that the ordinance was not in effect when the building was occupied. Mr. Dubelko <br />indicated that the code was in effect now and the Police can enforce it by siting the truckers. As <br />far as the fence, there is a property maintenance code that stipulates the owner of the parcel is <br />responsible to maintain the property. If the residents do not think the owners are maintaining <br />the site a complaint should be filed with the Building Department. The lighting complaints <br />about the retail and commerciai properties have come from many residents around North <br />Olmsted and there is currently legislation before Council pertaining to lighting issues. Mr. <br />Tallon was instrumental in pushing for this iegislation for many years and has been pretty much <br />responsible for bring about the way the ordinance is written. Mr. Dubelko encouraged all the <br />residents to keep in contact with the Building Department to help enforce the new ordinances. <br />It is to be hoped that there will not be any problems with the new owners, but if you. do please <br />make the Building Department aware of them as they can enforce the new ordinances. Mr. <br />Elbin suggested that the hours of operation would be from 9:00am to 9:00pm. Mrs. Egan <br />commented that she wanted to assure the residents that Babies "R" Us did not want to cause <br />any type of disruption to the community. She is not sure what the hours of deliveries would be <br />for this site as it was not up and running yet. Trucks will not be left running over niaht and <br />deliveries are only made during the store's business hours. 1VIrs. lEgan encouraged 1V1r. & Mrs. <br />Vine to let the store manager know it there is a problem with the trucks and they would address <br />the issue. Nlrs. Vine indicated that she has dealt with store managers in the past and found that <br />the store managers were not in a position to deal with the problem. She suggested that she has <br />contacted the owners of the businesses as well as the transpiration IDepartment in the past and <br />nothing was done. Mrs. Egan indicated that Babies "R" Us has their own trucking Department, <br />trucks and ti-uck drivers, so there should be no problems with the trucks. Babies "R" Us have <br />no intentions to disturb the residents. Mr. Elbin indicated that the owners would be glad to <br />work with the City, by posting signs or copies of the ordinance to help make the truckers more <br />aware. Mrs. Egan suggested she felt that once the business was in operation she did not feel the <br />trucks would park over night in the area anymore. Mr. Asseff suggested that truckers would do <br />what ever they want so the owners will need to be steadfast concerning what the truckers are <br />allowed to do. Mr. Tallon commented that he was going to strongly suggest that the developer <br />use a soundboard type material made for residential areas around the loading docks, which <br />should help buffer the noise from the residents. The developer can see a sample of the material <br />on Center Ridge Road at the new RTA turnaround. No further comments were made. <br />R. Tallon motion to send 17evelopers Diversified (Babies "R" Us) of 26520 Lorain Avenue to <br />the Architectural Review Board. The side of the truck dock should have some type of sound <br />8
