.4 <br />that once the lots were rezoned the developer would have to follow through with the proposed plans. <br />Councilman, Gareau thanked the Commissioners for giving him the opportunity to come before them and <br />help them have a better understanding as to what he was trying to accomplish with his ordinance. Mr. <br />Tallon questioned the City Engineer, P. Deichmann as to how they came up with the conclusion that lot 23 <br />(232-10-023) was not zoned residential. Mr. Deichmann indicated that on the original zoning map there <br />was a question regarding whether or not a 4 or 3 was supposed to be on parcel 232-10-023. The question <br />was, had there been a 3 or 4 on the map first. He reviewed that he had used a scale on the map to match <br />things up and he came to the conclusion that what appears to be a 3 really lines up with the line between <br />parcels 232-10-023 and 232-10-024. Mr. Tallon indicated that the reason he asked was because looking at <br />the layout of the land, in 1962 the lines were drawn to follow the layout of the existing business buildings. <br />He suggested that in 1962 parcel 232-10-023 was empty, and the only commercial building was the one on <br />the corner. He feels that parcel 232-10-023 should not be included in the retail business use area. The <br />purpose of the rezoning was to incorporate the commercial buildings that existed at the time and not to <br />incorporate residential parcels into the commercial. He feels that if there is any doubt as to whether or not <br />a parcel should be residential or business it should be given to the residential. Mr. Spalding indicated that <br />he agreed with Mr. Tallon, the zoning map was not designed to change residential lots it was to address the <br />existing business areas. Mr. Deichmann indicated that parcel number 232-10-023 .was not rectangular, so <br />that would have been taken into consideration. IVIr. Tallon indicated that if the scale is close then he feels <br />that the lot should go to the residential side. Mr. Deichmann indicated that Mr. Conway had also looked at <br />the zoning map independently from him and came to the same conclusion, and will be making a <br />deternunation on the parcel. Mr. Koeth suggested it could have been zoned retail because it didn't line up <br />with the other lots. Mr. Rymarczyk indicated that Mr. Conway had made a deterniination, which is parcel <br />232-10-023 is zoned retail business use. Mrs. 0'Rourke questioned who owned parcels 023, 024, and 025. <br />Councilman, Gareau indicated that Mr. Halleen owned all three of the properties. Mr. Deichmann indicated <br />that there was some confusion between sub lot 3 and 4 as the zoning map seems to indicate that sub lot 3 is <br />zoned residential. When you take the sub lot numbers and work them out on the parcel map sub lot 3 <br />seems to be retail business. Mr. Koeth indicated that the residents from Dewy Road had been before the <br />Plaruung Comxnission regarding this very issue and were admit about not letting the area be rezoned. He is <br />not convinced that the residents would want the rezoning to take place. This rezoning would be <br />encroaching upon the residents, as there would be an increase in the amount of noise and cars present. Mr. <br />Koeth further commented that he had doubts as to whether or not Mr. Halleen would follow through on his <br />promises as the issue of Mr. Halleen keeping his word has been one of the residents main complaints. <br />When KIA came before the Planning Commission to request additional lighting, the residents were opposed <br />to allowing the additional lights. Councilman, Gaieau''indicated ttiat he uriderstood that the-residents would <br />be opposed to anything being done to the two lots. He suggested that he was willing to put his self in the <br />position of being responsible for the rezoning. There is never going to be a full agreement of any type of <br />zoning issues, but the residents will have at least 7 or 8 opporlunities to have their concerns worked out <br />while the proposals go before all the Commissions and Council boards. He appreciates the sensitiviTy <br />regarding the area, but believes that a step needs to be talcen. If a proposal is done correctly and enhances <br />the Cities streetscape with a building which would set a standard. The City can then do their best to make <br />sure the residents concerns are satisfied short of leaving the lots empty. The AKA Tire center presently <br />extends behind a couple of homes on Dewey Road. He would like to see the line corner off the property <br />and head back to Lorain Road. Mr. Brennan suggested that there was one owner who owned all the parcels <br />in question and each has existing buildings, which are all eyesores. He commented that he had witnessed <br />numerous, numbers of residents coming before the Planning Commission meetings with complaints of Mr. <br />Iialleen not following through with promises that he had made to them. So why should the Plaivung <br />Commission think Mr. Halleen is going to follow through with any promises made now. He inquired as to <br />why council had not established an ordinance which deals with commercial property owners maintaining <br />their lots, like those which residents have to comply with.
