NOTE: This ordinance was addressed at the July <br />13, 1999 Planning Commission meeting at which time it was denied. <br />Chairman Tallon called all interested parties forward to discuss Councilman, Gareau's request. <br />Councilman, Gareau came forward to review his request. Councilman, Gareau apologized for not <br />attending the last meeting in which the ordinance was discussed, but he thought the Planning <br />Commissioners were on vacation as was Council. He thanked the board for allowing him the opportunity <br />to present his proposal. He suggested that he would start at exhibit A(a photograph looking north from <br />corner of Dewey Road and Lorain Road). Councilman, Gareau passed out photos for the board to review. <br />The three parcels that need to be rezoned are presently unoccupied at this time. The parcels are north west <br />of properiy currently zoned as general retail business. The area that is shaded dark green on the parcel <br />map page is presently zoned general business retail, the area that is highlighted red with blue lines through <br />the center is the area in question. The ordinance concerns sub lots 3, 4, and 5 on the map. He indicated <br />that he had met with the Building Commissioner and the City Engineer earlier that day. He believed if the <br />Commissioners looked at the zoning map that was provided, the Commissioners would understand why the <br />map is less than precise as to where the zoning line falls. He suggested that while speaking with the <br />Building Commissioner and City Engineer the area indicated by the green and red marker is accurate and <br />what the Building Commissioner would base his opinion on. The green boarder line on the north actually <br />cuts across the middle of the lot, (Parcel 232-10-044) where the line runs from north to south. Currently <br />there is a building located in the middle of the zoning line. On a future date that mistake will need to be <br />conected as there is no reason a parcel should be splii down the center. The area in question is parcels <br />232-10-024 and 025 only, It was found that parcel 232-10-023 was already zoned general business retail. <br />Which means parcel 232-10-023 would not need to be rezoned, according to the opinion of the Building <br />Corrunissioner. Councilman, Gareau indicated that the reason he took interest in the rezoning of the <br />proposed area was, he would like to establish a standard by which the City could follow on the west side of <br />town, as well as future development for the center of the town. He reviewed that he had worked very <br />closely with Mr. Schill on developing a facility that would enhance the appearance of the historical district. <br />Councilman, Gareau presented a site plan of a building and indicated that the plan was not a submittal but <br />rather an indication of what Mr. Halleen would like to do if the rezoning is passed. The area in question is <br />a car dealership, which IVIr. Halleen owns. Presently the cars are parked all over the lot. The proposed <br />building would sit about 10 feet off of Lorain Road and 70feet east of Dewey, which would require a <br />variance for front setback. The suggested building would be constructed entirely out of brick and mimic <br />the existing historical buildings. There are presently 4 buildings on the site, and 1VIr. Halleen has indicated <br />-- that he would be willing to use globe lighting, rod iron fencing and to coordinate the colors of -the existirig - <br />buildings. Councilman, Gareau suggested he had met with the property owners to the north and west and <br />as expected there were some concerns that would need to be addressed. He suggested that he had instructed <br />1VIr. Schill, (the architect), that he needed to address any issue or concerns prior to the plans being reviewed <br />by the Board of Zoning and Appeals, Plannuig Commission and Board of Zoning and Development. He <br />indicated that mounding as well as trees would be used to buffer the neighboring properties. The mounding <br />and trees would be anywhere from 4 foot to 6 feet high, with low-level lighting placed on Halleen's <br />property. The two parcels in question would be strictly used for displaying vehicles. He would like to see <br />the City incorporate a more unique architectural style, such as brick, masonry, neutral colors, earth tones, <br />awnings, things of that nature. Buildings could be brought closer to the road on an as needed bases. <br />Councilman, Gareau indicated that he would like to see the proposed development be used as an example <br />for other businesses in the historical district as well as other areas along Lorain Road. Currently there are <br />still a number of homes on the west end of Lorain and he would like to make sure that all those homes don't <br />turn into strip centers. The Planning Commission had indicated at their last meeting that they felt ihis <br />would be spot zoning. He commented that he didn't feel it was a case of spot rezoning, as he would like to <br />just clarify the area to make it consistent.
