?-` <br />R. Tallon motioned to send Horizon's Daycare Center to the Architectural. Review Board <br />and The Board of Zoning and Appeals. The Planning Commission would like the proposal <br />sent to the Safety Department for their opinion. The dumpster area to be brick to match the <br />building. The existing easement entrance to remain closed. The lighting height will not be <br />higher than 26 feet, from the top of the light to the bottom of the fixture or surface. The <br />board would like to see a softer light used as the proposed lighting would only causes glare, <br />so another type of light should be looked into. The loading zone to be located at the <br />southwest elevation and will be 12 x 25 feet. The proposed entrance to be located on David <br />Drive, and that the said entrance cut will accommodate a 3-lane drive. Mr. Grassa indicated <br />that a residential 12-foot light could be used. Nlrs. O'Rourke asked about a sidewalk from <br />the daycare to Lorain Road. Mr. Grassa indicated that there would be a sidewalk along the <br />entrance drive. A conditional use permit will need to be resubmitted. This proposal will <br />return to the Planning Commission on July 27, 1999, with a conditional use request. At that <br />time the board would like to see the samples that are used at the Architectural Review Board <br />meeting and the Safety Departments comments. The motion was seconded by T. Brennan and <br />unanimously approved. 1Vlotion Carried. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />V. CONIMUNICATIONS: <br />Council has referred the following Ordinances to the Planning Commission for their review... <br />1). Ordinance No. 99-77 <br />Mr. Tallon indicated that ordinance no. 99-77 addressed commercial lighting. Mr. Tallon read <br />allowed the following statement. * 1126.02 DRAWINGS, ETC. TO ACCOMPANY <br />APPLICATION. Applications for the building permits required under section 1126.01 shall be <br />accompanied by such drawings, sketches, plans, including landscaping plans, renderings, <br />photographs, material samples, and other iteins as shall be reasonably required by rule of the <br />Building Official in order to determine a proposal's compliance with the Zoning Code and all <br />other applicable codes of the City. In addition, al] such applications shall be accompanied by <br />exterior lighting plans which shall include data analyses, prepared by persons competent to do <br />so, concluding that the proposed exterior lighting system complies with the standards set forth in <br />section 1161.12 (Illumination of Parking Areas) of this Zoning Code and in Section 556.02 <br />(Lighting Nuisance Standards) of the General Offenses Code. Once a plan has been approved <br />and implemented no owner or occupant of property shall modify the plan without first <br />submitting to the Building Official modification plans and obtaining the approval of the City to <br />such proposed modification. 1161.12 ILLUNIINATION OF PARKING AREAS. (a) Parking <br />areas shall be thoroughly illuminated whenever determined necessary by the Planning <br />Commission to protect the public safety. Such illumination shall be designed and located so that <br />light sources are shielded from adjoining residential districts and street, and shall not be of <br />excessive brightness or cause a glare hazardous t pedestrian or motor vehicles. (b) Luminaries <br />Height, (1) The maximum luminary height in the Office Building District shall be 10 feet. (2) <br />The maximum luminary height in all other districts shall be 20 feet. However, the City Planning <br />Commission may approve luminary heights up to a maximum of 30 feet upon a showing by the <br />4
