Mr. <br />Brennan asked Mr. Dubelko if the City did indeed have to approve the units solely because the unit <br />met the Plaruiing and Zoning code. Mr. Dubelko indicated that if the State of Ohio's code permits <br />these units then the Planning Commissioners can not deny it simply because they don't like them. <br />Chapter 1126.04 of the Planning and Zoning Code covers the duties of the Plaiuiung Commission. <br />It indicates that, the board is to review if the proposal will have any significant adverse impact on <br />residential, commercial or other neighbors whose properties abut the property of the applicant. It <br />is up to the board to deternune if the modular unit in question will truly have an adverse effect on <br />either residential, commercial or other neighbors, vehicular or pedestrian safety, or aesthetically <br />upon the community. Mr. Brennan indicated the reason for his question was partly because there <br />was controversy about allowing this type of modular unit on Lorain Road, and partly because of <br />the comments made by the Architectural Review Board. Mr. Tallon suggested he thought the <br />comments from the Architectural Review Board were made because they were not in the habit of <br />reviewing temporary modular builclings. He indicated it was not clear in the Architectural Review <br />Boards minutes if the plants were acceptable or not. He further indicated that he would like the <br />Architectural Review Board to review the landscaping that had been submitted, to malce sure the <br />plants would survive in planter boxes. <br />R. Tallon motioned to approve Motorcars Chrysler Plymouth Jeep of 27500 Lorain Road, their <br />proposal that consists of using a self-contained modular office (trailer) on the existing car lot. In <br />addition the board would like the Architectural Review Board to review the landscape plans for <br />comments and that the down spouts will need to be tied into an existing drain underground. The <br />color of the awing will be gray to match the building and the unit itself will be a light off gray <br />color. The air conditioning protrusion is to be enclosed on the north east side of the unit, and the <br />enclosure used for the air conditioning is to match the color of the unit. The motion was seconded <br />by, W. Spalding and unanimously approved. Motion Carried. <br />X. ADJOURNMENT: T. Brennan motioned to excuse the absence of Board member, S. Asseff and <br />adjourn the meeting. In the framing of the motion R. Tallon indicated that the motion should <br />include observing the month of August as vacation for the Planning Commission.
