which will take the drainage over too interstate 480. Once the plans are submitted, they will be submitted <br />to the Department of Transportation for their permission to use their drainage system. If the Department <br />of Transportation does not approve the plans, it will be up to the developer to come up with an acceptable <br />system such as a larger pipe or pump. The developer wants to bypass the existing system and go directly <br />into interstate 480, which would have no effect on the other residents. Ms. Schroder suggested five new <br />houses would mean an increase in the amount of cars parking on the street. There are already a lot of cars ` <br />that park in the street and she is worried about emergency vehicles being able to get down the street and <br />turn around. Mr. Koeth indicated there is a rule that all the streets have to be cleared of cars at night. Ms. <br />Schroder indicated the extra cars have been parking on the empty lot. Mr. Lang, a resident, who lives on <br />Kennedy Ridge, reiterated what Ms. Schroder had just said about cars parking on the street. He would <br />also like the Planning Commission to make a specific note that there are not any storm sewers on <br />Kennedy Ridge, he drains right into the ground. He suggested there were only sanitary sewers, the storm <br />sewers are the ones O.D.O.T. put in when they built interstate 480. He would like it stipulated that all of <br />Mr. Lusardo's lots drain in an easterly and southerly direction so there would be no encroaclunents of the <br />neighbors to the west. Mrs. 0'Rourke indicated they would have to set that up even before the plans were <br />submitted. Mr. Lang indicated that lot sizes are sufficient for homes of at least an equal nature that <br />already exists on the eastern end of the street. He questioned if the developer had any sketches of the <br />houses that would be built on the lots. Mr. Lusardo indicated that everything would be built according to <br />code, he was not your typical track builder. Mr. Koeth indicated he would have to conform to B <br />residence of the zoning code. Mr. Lang also wanted to bring to the commissioner's attention that there is <br />not an emergency vehicle in the city that can make the turn at the end of the street. He suggested <br />presently there were no curbs, and he does not want to be accessed for sewers iu the future. He further <br />requested that the constniction of the new homes not change the RFD mail system to a walk system. He <br />indicated if the mailing system changed to a walk system, the residents would have to put in sidewalks. <br />Mr. McDermott indicated the City would require the developer to put in sidewalks for the new houses, <br />but unless council enacts it the older homes would not be required to put in sidewalks. Mr. Lusardo <br />indicated it was his experience that if it was a RFD route it would remain so, the postal department does <br />not want to hire more people to deliver mail.. About the parking issues all of the new homes will have <br />t-,vo car garages with a 50'foot driveway, which should be sufficient to park their cars. <br />R. Koeth motioned to approve the Lusardo Homes; Subdivision, Preliminary Plan their proposal is to <br />subdivide permanent parcel 4236-10-008 into five residential lots. Location is the south side of Kennedy <br />Ridge Road at the east adjacent I-480 right-of-way. This case is to go to the Board of Zoning Appeals <br />and the Planning Commission recommends the variance be approved. The motion was seconded by K. <br />0'Rourke and unanimously approved. Motion Cart•ied. In the framing of the motion Mr. Dubelko <br />indicated that the code governs what the discretion is in ruling on what is proposed in minor subdivisions <br />and drainage is not something that the Commission has discretion in. The clerk announced that the case <br />would go to the Board of Zoning Appeals meeting on April 1, 1999 and that no fiirther notices would be <br />sent out. She also indicated Mr. Lusardo would need to submit an application and pay the fees to the <br />building department as soon as possible. <br />3). Jim Held; Lot Split Plat (Revised): <br />The proposal is to divide permanent Parcel Number 231-21-009 into two parcels. The location is the "L" <br />shaped lot adjoining the corner lot at the southeast corner of Walter Road and South Oxford Oval. <br />Zoning is C-Residence, Single entirely and both proposed parcels conform to frontage, depth and area <br />requirements of the Zoning Code. Note: Planning Commission on October 27, 1998 approved a sinnilar <br />proposal; however the plat was not recorded. <br />Acting Chairman, Koeth called all interested parties forward to present their proposal. After waiting a <br />reasonable time period, Mr. Koeth indicated since there was no one present to represent this proposal it <br />would be tabled until the next meeting. <br />R. Koeth motioned to table the Jim Held; Lot Split Plat, until the next planning commission meeting on <br />March 23, 1999. The motion was seconded by W. Spalding and unanimously approved.
