1) A 49square foot (1.1-%) variance for a shed exceeding 2% rear yard coverage, (code permits 91 <br />square ft., applicant shows 140 sqft.). <br />Which is in violation of Ord. 90-125 section, (1135.02 D 1). <br />Chairman Gomersall called all interested parties forward, and reviewed the variance requested. Mr. & <br />Mrs. Gabel came forward to review their request. Mr. Gomersall questioned if there were any questions <br />from the board or audience members. No further comments were made. <br />J. Konold motioned to grant Jeffrey K. Gabel of 4440 Georgette Ave. their request for variance (1123.12). <br />Which consists of a shed and that the folloNving variance be granted: <br />1) A 49square foot (1.1-%) variance for a shed exceeding 2% rear yard coverage, (code pernuts 91 <br />square ft., applicant shows 140 sqft. Which is in violation of Ord. 90-125 section, (1135.02 D 1). The <br />motion was seconded by W. Kremzar and Lmanimously approved. Variance Granted. <br />4. Ruth Kess: 25 383 Fawn Drive: <br />Request for variance (1123.12). The proposal consists of continuing a deck into side yard setback. <br />The following variances are requested: <br />1) A 5-foot variance for side yard. (code requires 10 ft., applicant shows 5 ft.) section (1135.07 A). <br />2) An S-foot side yard variance for distance between deck and neighbors' detached garage. (code <br />requires 15 ft., applicant shows 7 ft.), section (1135.02 C 2). <br />Wluch is in violation of Ord. 90-125 section, (1135.07 A), (1135.02 C 2). <br />Chairman Gomersall called all interested parties forward, and reviewed the variances requested. Mr. Kess <br />came forward to review lus mother's request. Mr. Gomersall questioned if there were any questions from <br />the board or audience members. Mr. Maloney indicated that there was a slope and asked i£there would be <br />a railing put on the deck for safety. Mr. Kess indicated that a railing would be put in place. <br />J. Maloney motioned to grant Mrs. Kess of 25383 Fawn Drive her request for variance (1123.12). Which <br />consists of continuing a deck into the side yard setback and that the following variances be granted: <br />1) A 5-foot variance for side yard. (code requires 10 ft., applicant shows 5 ft.) section (1135.07 A). <br />2) An 8-foot side yard variance for distance between deck and neighbors' detached garage. (code <br />requires 15 ft., applicant shows 7 ft.), section (1135.02 C 2). Which is in violation of Ord. 90-125 <br />section, (1135.07 A), (1135.02 C 2). The motion was seconded by W. Kremzar and unanimously <br />approved. Variances Granted. <br />North Olmsted Baptist Church; 4816 Dover Center Road: <br />Request for special pernut (1165.02). Proposal consists of adding an addition to a non-conforming <br />building. The following pernut is requested: <br />A special pernut to add to a non-confornung building, (current structLire does not meet the 50' setback <br />requirements). <br />Which is in violation of Ord. 90-125 section, (1165.02). <br />Chairman Gomersall called all interested parties forward, and reviewed the variances requested. Mr. <br />Beatty, with Star Builders, Councilman Limpert, representing Mill Road Condo's, Ms. Zekany, & Ms. <br />Wood, from Mill road Condo's and Ms. Borkowski, an abutting neighbor came forward. Mr. Beatty <br />reviewed the addition that would be added to the church. Mr. Gomersall requested that Mr. Beatty go <br />over the blue prints for the neighbors so they would have a better understanding of what was taking place. <br />Mr. Beatty indicated that the addition would be 50 feet from the condo property line. The existing <br />building is the a non-confornung builciing because it is only 15 feet off the property line, which is why a <br />special permit is needed. There are existing pine trees along the property line and the addition will be 50 <br />feet from the trees. Mr. Beatty reviewed pictures with the neighbors so that they could understand what <br />would be taking place. NIs. Wood indicated that if a variance was allowed the church would only be 10 <br />feet off the condo's property. Mr. Beatty commented that the church did not require any variances for the <br />3
