o-? <br />1) A 6 inch height variance for an 80 foot long fence in a front building setback, (Code limits height to <br />30", applicant shows 36"), (1135.02 F 1). <br />2) A 45 square foot variance for a shed which exceeds 2% of rear yard, (code pernuts 35sq ft, applicant <br />shows 80sq ft), ( 1135.02 D 1). <br />Which is in violation of Ord, 90-125 section, (1135.02 D 1, F 1). <br />Chairman Gomersall called all interested parties forward, and reviewed the variances requested. Mr. <br />Wyrwas, came forward to present his proposal. He indicated that he had a new drawing. Mr. Gomersall <br />suggested the board had all the information they needed and reviewed that there was a potential hazard for <br />kids riding their bikes or skateboards on the sidewalks. Mr. Koberna inquired as to what the height of the <br />fence would be. Mr. Wyrwas indicated that it would be a 3-foot high picket fence, as the curb was a very <br />dangerous corner and he is trying to keep his children safe. He commented that Coe Street ended right at <br />his back yard. A lot of drivers jump the curb, which is lined up to his kitchen. Mr. Gomersall suggested <br />that there was an existing tree, which the fence should be placed in from on the property or it should be <br />a.ngled so that the fence wouldn't be so close to the sidewalk. Mr. Wyrwas indicated that the fence would <br />be 50% open face and both he and his wife could see over the fence while driving by in their cars. Mr. <br />Koberna suggested that he was concerned about children riding bikes hitting the fence. Mr. Gomersall <br />suggested moving the fence in 30 inches and go diagonal to the sidewalk. 1VIr. Kremzar suggested there <br />was an existing fence that was like what was being suggested in the area. Mr. Conway questioned how <br />long Mr. Wyrwas's driveway was. Mr. Wyrwas indicated that he had a very short driveway maybe 15 <br />feet. Mr. Conway reviewed that Mr. Tallon was suggesting that Mr. Wyrwas place the proposed fence 12 <br />inches from the sidewalk and from the corner post put a 45-degree angle either way. Mr. Wyrwas repeated <br />what he understood Mr. Conway to be suggesting. Mr. Wyrwas questioned if he would be given a drawing <br />to indicate what the board wanted. Mr. Conway suggested when Mr. Wyrwas came in for his variance the <br />building department would help him out. No further comments were made. <br />J. Maloney motioned to approve Edgar Wyrwas of 23889 Oak Lane his request for variance (1123.12) <br />as amended and agreed upon. Which consists of a fence and shed and that the following variances be <br />granted: <br />1) A 6-inch height variance for an 80-foot long fence in a front building setback.lVote: A 45 degree angle <br />be created some 30 inches back on each leg of the fence from the proposed corner post that is shown as 12 <br />inches from the walk and 30 inehes from the drive. That would mean placing one post at a point 12 inches <br />off the sidewalk and 60 inches from the driveway. The second post would be placed 30 inches off the drive <br />and 42 inches from the sidewalk. The fence connecting these two points would than create a 45 degree <br />angle, (Code lunits height to 30", applicant shows 36"), (1135.02 F 1). <br />2) A 45 square foot variance for a shed which exceeds 2% of rear yard, (code permits 35sq ft, applicant <br />shows 80sq ft), ( 1135.02 D 1). <br />Which is in violation of Ord. 90-125 section, (1135.02 D 1, F 1). The motion was seconded by J. Maloney <br />and unaiumously approved.
