ROLL CALL: <br />Chairman Gomersall called the meeting to order at 7:30 p.m. i <br />PRESENT: Chairman, R. Gomersall, Board members, J. Maloney, T. Kobe ?rna, and W. Kremzar. <br />ALSO PRESENT: Law Director, M. Gareau, Assistant Building Commissioner, T. Rymarczyk, and <br />Clerk of Commissions, D. Rote. ? <br />ABSENT: Board member, J. Konold. <br />II. DISPOSITION OF NIlNUTES: The minutes of April 1, 1999, Board of Zoning Appeals meeting has been <br />submitted for approval. W. Kremzar moved to approve the April 1, 1999 minutes as written. The motion <br />was seconded by, T. Koberna and unanimously approved. Motion Carried. <br />Chairman Gomersall advised that each case would be judged on the physical situation peculiar to <br />iiself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. <br />1. Gerald Pochatek; 30019 Wellington Drive: <br />Request for variance (1123.12). Proposal consists of a shed. <br />The following variance is required: <br />A 5' foot variance to install a shed 5'ft from the rear property line, (Code requires 10'ft setback). <br />Which is in violation of Ord. 90-125 section, (1135.02 D4). Note: the Backyard coverage would <br />not, be affected by the proposed shed. The total of the existing deck, pool and pool deck, and the <br />proposed shed will total 738sq ft, or 12.4% of the rear yard, 20% of the rear yard equals 1189sq <br />ft. <br />Chairman Gomersall called all interested parties forward and reviewed the variance being <br />requested. Mr. Pochateck came forward to present his proposal. Mr. Gomersall reviewed with <br />Mr. Pochateck that all the board members had been to the site. He also indicated he did not have <br />a problem with the variance being requested. Mr. Gomersall asked if there were any questions <br />from the other board members or audience members. No further comments were made. <br />J. Maloney motioned to approve Gerald Pochatek of 30019 Wellington Drive, his request for <br />variance (1123.12). Which consists of a shed, and that the following variance be granted: <br />A 5' foot variance to install a shed 5'ft from the rear property line, (Code requires 10'ft setback). <br />Which is in violation of Ord. 90-125 section, (1135.02 D4). The motion was seconded by, W. <br />Kremzar and unanimously approved. Variance Granted. <br />2. Donatos Pizza: 26180 Lorain Road: <br />Request for variance (1123.12). 1'roposal consists of allotted parking spaces. <br />The following variance is required: <br />1) A variance for 12 additional seats for a total of 66 seats. <br />Which is in violation of Ord. 90-125 section, (1161.05 R). <br />Note: Code allows 2 seats for each parking space. Applicant has 27 spaces which allows 54 <br />seats. <br />Chairman Gomersail called all interested parties forward. As no one came forward to present <br />Donatos proposal Mr. Gomersall indicated he would move on to the next case.
