14 Daniel & Martha McKav: 5586 Whitehaven: <br />Request for variance (1123.12). Proposal consists of an above ground swimming pool and additional deck <br />and rails. The following variance is required: <br />A 21% variance for rear yard coverage, (code pernuts 20% or 745.2sq ft, existing garage is 520sq ft, existing <br />deck 400sq ft, plus proposed pool & deck 130sq ft= 1050sq ft or 304.8sq ft over). Which is in violation of <br />Ord. 90-125 section (113,5.02 d 2). <br />Chairman Gomersall called all interested parties forward, and reviewed the variances requested. Mr. & Mrs. <br />McKay, and Mrs. Csornok a concerned neighbor came forward. Mr. Gomersall suggested the property was <br />being over built. Mr. McKay suggested a variance was granted last year for the deck and garage. Mr. <br />Gomersall suggested the existing deck was huge and adding a pool would be too much. Mr. McKay <br />suggested the dimensions of the deck were wrong, and they had gotten the smallest pool they could which is <br />10'foot. Mrs. Csornok suggested she was against the pool being added as she had stated in the letter. Mr. <br />Konold asked if there could be a compromise. Mr. McKay suggested the only other thing that could be done <br />is to remove some of the existing deck. Mrs. Csornok suggested when the garage was built the drain was <br />supposed to drain one way and they tied it into our drain until the building department made them change the <br />hookup. She would like to know how the drainage will be addressed for the pool. Mr. Gomersall suggested <br />the only thing that could be done is to remove some of the deck. Mrs. McKay indicated they could remove <br />part of the deck to accommodate the pool. They had not planed on a pool when they built the deck. Mrs. <br />Csornok suggested she thought the McKay's planed the deck, garage, and pool before they purchased the <br />house. Mr. Gomersall suggested that was not an issue, and all the board members had read Mrs. McKay's <br />comments. Mr. McKay asked how much of the deck would need to be removed. Mr. Gomersall suggested <br />removing 7'feet of the deck and incorporate the pool into the deck. Mr. McKay suggested he could remove <br />enough deck for the pool. Mrs. Csornok asked if the tree in the back yard would have to come out. Mrs. <br />McKay suggested the pool would not effect the existing tree. Mrs. McKay suggested they could remove part <br />of the deck. Mr. Gomersall suggested cutting back 10'feet. Mr. McKay suggested he could cut the deck. <br />He would need to know how fare out from the house the pool would be allowed. Mr. Gomersall suggested it <br />not be more than 23'feet from the back of the house to the furthest end of the pool. Mr. McKay suggested he <br />could work with the board and remove some of the deck. Mr. Conway reviewed that the end of the pool <br />would not exceed 23'feet. Mr. Gomersall asked if Mrs. Csornok had any further comments. Mrs. Csomok <br />indicated she was still against the pool and didn't feel that the board should allow the variance to people that <br />had lied to the board members in the past. Mr. Gomersall suggested the board could only address issues <br />before them at the present meeting. No further questions were asked. <br />R. Gomersall motioned to grant Daniel & Martha McKay of 5586 Whitehaven their request for variance <br />(1123.12). Their proposal with the agreed upon changes to read as follows: <br />The pool is to be incorporated into the existing deck and not to exceed 23'feet (deck and pool) from the <br />house. The pool will be slid into the deck so that 23'feet is not exceeded. A rear, yard lot coverage will not <br />be needed as the applicant will be within the square footage granted for the deck. Which was in violation of <br />Ord. 90-125 section (1135.02 d 2). In the framing of the motion Mr. Conway suggested the exact wording <br />would be available for the boards review at the next regularly scheduled meeting. The motion was seconded <br />by W.
