T. Koberna motioned to approve Hania Stadtler of 24057 Ambour Drive her request for variance (1123.12). <br />Her proposal consisting of a fence, and that the following variance be granted: <br />A 6"inch variance for excess height, and 17% less open face than required, (Code pernuts not more than <br />30"inches in fence height and at least 50% face open between front building line and street right of way line. <br />applicwt request 36"inch height in front setback, with picket's 3.5"inches wide spaced 1-3/4" inches apart, <br />making face of fence 33% opens). Which is in Violation of Ord. 90-125, section (1135.02 f-1). Note: The <br />fence will incorporate an arbor 7' foot 6"inches high X 6'feet wide X 2' feet deep which is allowable as a <br />landscape feature. The motion was seconded by W. Kremzar and unanimously approved. Variance <br />Granted. <br />7. Giant Eagle; 23100 Lorain Road: <br />Request for variance (1123.12). Proposal consists of a sign package. <br />The following variances are required: <br />1) A variance to alter a prohibited pole sign (1163.22 a). <br />2) A variance to alter a non-conforxning sign without bringing the entire sign into compliance, (1163.19). <br />3) A 143square foot variance for wall signage, (Code permits 75sq ft applicant request 218sq ft.), (1163.12 <br />a). Which is in violation of Ord. 90-125, section (1163.22 a), 1163.19), and (1163.12 a). <br />Chairman Gomersall called all interested parties forward, and reviewed the variances requested. Mr. Bizjak, <br />of Brilliant electric signs, presented the proposal. Mr. Gomersall asked if the cunent sign was the same as <br />the sign that was changed without coming in for a permit. Mr. Bizjak suggested he was correct. Mr. <br />Gomersall asked if the pole sign would have the same size signage that is presently in place. Mr. Bizjak <br />suggested the signage on the wall would be only longer, because of the letters. He further suggested the <br />eYisting logo sign would be removed by the end of the year. No further questions were asked. <br />W. Kremzar motioned to approve Giant Eagle of 23100 Lorain Road their request for variance (1123.12), <br />and that the following variances be granted: <br />1) A variance to alter a prohibited pole sign (1163.22 a). <br />2) A variance to alter a non-conforming sign without bringing the entire sign into compliance, (1163.19). <br />3) A 143square foot variance for wall signage, (Code permits 75sq ft applicant request 218sq ft.), (1163.12 <br />a). Which is in violation of Ord. 90-125, section (1163.22 a), 1163.19), and (1163.12 a). The motion <br />was seconded by J. Konold and unanimously approved. Variances Granted. In the framing of the <br />motion R. Gomersall stated, " This variance is granted only as to the specific relief requested. The City <br />is currently involved in a federal lawsuit and has agreed not to enforce its prohibition against pole signs <br />until the lawsuit is resolved. Should the lawsuit resolve in favor of the City, your pole sign will be <br />unlawfully non-conforming under City law and will have to be removed unless you obtain another <br />variance at that time. <br />Giant Eagle: 4700 Great Northern Blvd.: <br />Request for variance (1123.12). Proposal consists of a sign package. <br />The following variances are requested: <br />1) A 130.3 square foot variance for sign face area for sign # 1(Code permits 75sq ft. they request 205.3sq <br />ft. (1163.12 A) <br />2) A variance to erect a second wall sign #4 (Code permits 1, they request 2), (1163.12 A). <br />3) A 28.6 square foot variance for business unit sign face area (Code permits 265sq ft. they request 293.6sq <br />ft. which includes the existing Star Bank sign), (1163.11 C). Which is in Violation of Ord. 90-125 <br />section (1163.12 A) and (1163.11 C). <br />Chairman Gomersall called all interested parties forward. Mr. Bizjak from Brilliant Signs was present to <br />present the proposal. Mr. Gomersall indicated that both Giant Eagle and Firstar Bank would be addressed at <br />the same time as the signage would be on the same mansard. Mr. Bizjak suggested he would prefer they be <br />addressed together. Mr. Gomersall reviewed the variances being requested for Giant Eagle. Mr. Bizjak <br />suggested the Open 24 Hours sign is about 24 square feet. Mr. Konold asked if Starbank sign would be <br />removed. Mr. Bizjak suggested the Starbank sign would be removed. Mr. Gomersall reviewed the 3 signs <br />that were presently in place. Mr. Gomersall asked if all the board members understood what was being <br />requested for Giant Eagles signage, and asked Mr. Bizjak to review Firstar banks signage. Mr. Bizjak <br />suggested Firstar signage would be slightly smaller in size than what is presently in place. He suggested the
